(a) The County Clerk is hereby authorized to charge fees to defray the actual cost of issuance of the following documents and the provision of the following services, notwithstanding the fees otherwise set or limited by State law. (b) When a digital signature is required in connection with any document issued or service provided by the County Clerk, an additional fee shall be charged to a person requesting that document or service. This additional fee shall consist of the actual expense incurred by the County Clerk in processing the digital signature. The County Clerk shall publish on its website the amount of any additional digital signature fee, and in case of any change in the amount, shall update the published fee listing quarterly.
(c) Fees collected by the County Clerk pursuant to this Section 8.33.1 shall be deposited with the City and County Treasurer. Portions of the fees for marriage licenses shall be disbursed in accordance with California Government Code Sections 26840, 26840.1, 26840.3, 26840.7, and 26840.8, and San Francisco Administrative Code Section 10.100-336.
(d) Fees set in this Section 8.33.1 in subsection (a) are applicable to fiscal year 2024-2025. Those fees shall be adjusted each year, without further action by the Board of Supervisors, to reflect changes in the relevant Consumer Price Index, as determined by the Controller, and to produce revenues sufficient to support the costs of providing the services for which the fees are assessed, but which will not produce revenue which is significantly more than the cost of providing the services for which the fees are assessed, also as determined by the Controller.
(1) No later than April 15 of each year, the County Clerk shall submit its current fee schedule to the Controller, and shall report to the Controller the revenues generated by the fees for the prior fiscal year and the prior fiscal year’8.33.1. The Controller shall apply the price index adjustment and if necessary, adjust the fees upward or downward for the upcoming fiscal year as appropriate to ensure that costs of providing the services are recovered without producing revenue which is significantly more than such costs to produce a new fee schedule for the following year.
(2) No later than May 15 of each year, the Controller shall file a report with the Board of Supervisors reporting the new fee schedule and certifying that: (A) the fees produce sufficient revenue to support the costs of providing the services for which each fee is assessed, and (B) the fees do not produce revenue which is significantly more than the costs of providing the services for which each fee is assessed.

(b) All requests for copies of records on file shall be subject to the standard fees in subsection (a) except for requests initiated and processed entirely as self-service requests. A self-service request is a request for one or more specified documents, initiated by the requester through the designated portion of the Assessor-Recorder’s website, that is fulfilled by automated electronic download or automated email delivery to the requester, and does not involve any other service (including but not limited to searching for specific documents, certification or conforming of copies, or acceptance of the request other than through the designated portion of the Assessor-Recorder’s website). For a request for all records within a specified date range, the Office of the Assessor-Recorder may, in its discretion, charge lower fees than subsection (a) requires to more accurately reflect the actual costs of fulfilling the request.
(c) Fees received by the Assessor-Recorder under this Section 8.33.2 shall be deposited with the City and County Treasurer.

The Tax Collector is hereby authorized and directed to advertise the sale of tax-defaulted real estate and all specific parcels intended for tax-default sale by preparing lists which include all parcels included in the tax sale and the specific information for each parcel that is required to be disclosed by State law and mailing those lists to interested persons upon their specific request. The Tax Collector is hereby authorized to charge and collect a fee of $20 for each list of tax-defaulted real estate parcels mailed to interested persons in advance of the date when the notice of sale is published in a newspaper of general circulation. This fee represents the reasonable cost of preparing and mailing the list to interested prospective bidders.

(a) Application for Separate Valuation. Pursuant to Section 2821 of the California Revenue and Taxation Code, a fee of fifty dollars ($50.00) shall be collected by the Tax Collector at the time any person applies to the Tax Collector to have any parcel separately valued on the current roll for the purpose of paying taxes. The fee shall be for the actual costs incurred by the Tax Collector for the processing of an application for separate assessment, and the initial ongoing costs of separate assessment, billings, and mailings. The fee may be billed separately or prior to initial separate tax bills, or both, or collected on subsequent tax bills, and shall be deposited in the General Fund.
(b) Delinquent Property Taxes – Installment Payments. Pursuant to Section 4217 of the California Revenue and Taxation Code, persons that request to pay delinquent property taxes in installments shall be subject to a processing fee of twenty dollars ($20.00). The fee shall be paid to the Tax Collector and may be collected on the tax bill.
(c) Preparation and Provision of Documents. Pursuant to Section 162 of the California Revenue and Taxation Code, the Tax Collector shall charge and collect a fee of one dollar ($1.00) for preparing each of the following documents:
(1) A certified copy of a redemption certificate;
(2) A certified copy of an installment redemption receipt;
(3) A certificate of payment showing taxes paid;
(4) A certified copy of an assessment as entered on the assessment role.
The fee for providing a copy of any of these records or documents by photographic process shall be the actual cost thereof plus the sum of one dollar ($1.00). The fee shall be placed in the General Fund.
(d) Notary Fees. Any person requesting notary service shall pay the following fees:

(e) Notary fees received by the Tax Collector shall be deposited with the City and County Treasurer. Fees charged for notary services provided by the Tax Collector shall be adjusted, without further action of the Board of Supervisors, to reflect changes in Government Code Section 8211, or any subsequent amendment of that section.
(f) Notice of Delinquency. Pursuant to California Revenue and Taxation Code Section 2621 and California Government Code Section 54985, after the second installment of taxes on the secured roll is delinquent, the Tax Collector may charge a forty-five dollar ($45.00) fee for preparing the delinquent tax records and for giving notice of delinquency on each separate valuation on the secured property tax roll of (a) real property, except possessory interests; and (b) possessory interests; and personal property cross-secured to real property.
(g) Redemption of Tax-Defaulted Property. Pursuant to California Revenue and Taxation Code Section 4102 and California Government Code Section 54985, the Tax Collector may charge a fifty-five dollars ($55.00) fee for processing the redemption of each separately valued tax-defaulted parcel.
(h) Automatic Adjustment for Inflation. Beginning with fiscal year 2009-2010, the fees set in subsections (f) and (g) shall be adjusted each year, without further action by the Board of Supervisors, to reflect changes in the relevant Consumer Price Index, as determined by the Controller.
No later than April 15th of each year, the Tax Collector shall submit its current fee schedule to the Controller, who shall apply the price index adjustment to produce a new fee schedule for the following year.
No later than May 15th of each year, the Controller shall file a report with the Board of Supervisors reporting the new fee schedule and certifying that: (a) the fees produce sufficient revenue to support the costs of providing the services for which each fee is assessed, and (b) the fees do not produce revenue which is significantly more than the costs of providing the services for which each fee is assessed.

(a) The City shall charge a fee for any credit or debit card transaction processed by the City unless:
(1) An office or department finds that collection of moneys due will be facilitated by not charging such a fee; or
(2) The City is prohibited from charging a fee for any particular credit or debit card transaction by a rule imposed by the credit or debit card issuer.
(b) The amount of the fee shall not exceed the reasonable costs incurred by the City related to credit and debit card transaction processing and in no event shall exceed:
(1) 3.25% for any credit card transaction;
(2) $3.95 for any debit card transaction, except for transactions specified in subsection (3); or
(3) 3.25% for any debit card transaction with the San Francisco Public Utilities Commission.

(a) The Juvenile Probation Department is hereby authorized to charge fees to defray the actual costs including investigation costs, of stepparent adoptions, pursuant to Civil Code Section 227.30. Maximum charge shall not exceed $200 per adoption and the Department may waive, reduce, or defer the fee when payment would cause economic hardship to the prospective parent which would be detrimental to the adoptive child's welfare.
(b) All fees received by the Juvenile Probation Department in payment for stepparent adoptions shall be deposited in the general fund and shall be used by the Department in providing such services.

(b) The Clerk of the Board is further authorized, in his or her best discretion, to waive, partially or wholly, any of the fees authorized by this Section when exigent circumstances arise, such as, but not limited to, the need to work cooperatively with other governmental agencies, or the inability of the requesting person to pay for the requested service.
(c) Each of the fees listed above shall be adjusted annually to reflect changes in the Consumer Price Index, as determined by the Controller, and shall be rounded to the nearest whole dollar.

The Public Transportation Department is hereby authorized to charge fees to defray the actual cost of processing and issuing Regional Transit Discount Identification Cards. Any persons requesting such cards shall pay the following fees:

All fees previously collected by the City under GIS data license agreements entered into since July 1, 1998 and before the effective date of this Section are hereby ratified.

(a) Property Tax Certificate. The Controller may collect a fee of $40.00 for issuing a property tax certificate under California Government Code Section 66492 or its successor.
(b) W-2 Replacement. The Controller may collect a fee of $20.00 for issuing a replacement W-2 form.

(a) Authority. The Mayor's Office of Housing and Community Development or its successor ("MOHCD") is hereby authorized to charge fees to defray the cost of issuing, administering, and processing documents related to certain housing transactions. Said fees shall be due at the time of filing an application. Failure to pay such fees shall result in a return of the application as incomplete to the applicant. Any persons requesting or requiring the following services shall pay the following fees:

Fees charged for other actions not specified above shall be based on actual costs that MOHCD incurs in administering and processing the action or procedure and shall be charged on a time and materials basis. MOHCD shall provide the applicant with a written estimate of said costs at the time of application, and the applicant shall pay such fees prior to the time that the application is deemed complete. To the extent that the estimated fees do not cover actual costs, any outstanding amount due shall be a condition of MOHCD's final decision on the action or procedure. To the extent that the estimated fees exceeded the actual costs, MOHCD shall refund the excess amount to the applicant within a reasonable period after MOHCD's final decision on the action or procedure.
(b) Additional Costs. In instances where administration of any application or document is or will exceed the fee amount established pursuant to Subsection 8.43(a), the Director of the Mayor's Office of Housing and Community Development, in his or her discretion, may require an applicant to pay a sum in excess of the subject fee amounts. This additional sum shall be sufficient to recover actual costs that MOHCD incurs and shall be charged on a time and materials basis. The Director also may charge any time or materials costs that other agencies, boards, commissions, or departments of the City, including the City Attorney's Office, incur in connection with the processing or administration of a particular application. Whenever additional fees are or will be charged, the Director, upon request of the applicant, shall provide in writing the basis for the additional fees or an estimate of the additional fees to be charged.
(c) Payment of fees charged under this Code does not waive the fee requirements of other ordinances and rules and regulations pursuant thereto.
(d) Fee Calculation Method. Establishment of the fees for each category and use specified in Subsection 8.43(a) shall be based on the Department's actual costs to process and administer the particular application. Said fees may include the actual costs that other agencies, boards, commission, or department of the City incur in connection with processing or administering these programs. Beginning with fiscal year 2011-2012, fees set in this Section may be adjusted each year, without further action by the Board of Supervisors, to reflect changes in the relevant Consumer Price Index, as determined by the Controller. No later than April 15th of each year, the Director shall submit MOHCD's current fee schedule to the Controller, who shall apply the price index adjustment to produce a new fee schedule for the following year. No later than May 15th of each year, the Controller shall file a report with the Board of Supervisors reporting the new fee schedule and certifying that: (a) the fees produce sufficient revenue to support the costs of providing the services for which each fee is assessed, and (b) the fees do not produce revenue which is significantly more than the costs of providing the services for which each fee is assessed. The Controller shall, if necessary, adjust the fees upward or downward for the upcoming fiscal year as appropriate to ensure that the Mayor's Office of Housing and Community Development recovers the costs of operation without producing revenue that is significantly more than such costs. The adjusted rates shall become operative on July 1.

(b) For the respective fees in the above chart that are charged on a per square foot basis, the fee shall include any fraction of a square foot.
(c) Automatic Adjustment. Beginning with fiscal year 2024-2025, the fees set in subsection (a) shall be adjusted each year, without further action by the Board of Supervisors, to reflect changes in the relevant Consumer Price Index, as determined by the Controller, and to produce revenues sufficient to support the costs of providing the services for which the fees are assessed, but which will not produce revenue which is significantly more than the cost of providing the services for which the fees are assessed, also as determined by the Controller.
(1) No later than April 15 of each year, the City Administrator shall submit its current fee schedule to the Controller, and shall report to the Controller the revenues generated by the fees for the prior fiscal year and the prior fiscal year’s costs for the services for which the fees are assessed, as well as any other information that the Controller determines appropriate to the performance of the Controller’s duties set forth in this Section 8.44. The Controller shall apply the price index adjustment and if necessary, adjust the fees upward or downward for the upcoming fiscal year as appropriate to ensure that costs of providing the services are recovered without producing revenue which is significantly more than such costs to produce a new fee schedule for the following year.
(2) No later than May 15 of each year, the Controller shall file a report with the Board of Supervisors reporting the new fee schedule and certifying that: (a) the fees produce sufficient revenue to support the costs of providing the services for which each fee is assessed, and (b) the fees do not produce revenue which is significantly more than the costs of providing the services for which each fee is assessed. The adjusted fees shall become operative on July 1.
