Request for suspension of the provisions of law requiring competition shall be accompanied by a specific statement from the appointing authority showing the peculiar and exceptional qualifications of a scientific, managerial, professional or educational character required, together with the reasons why competition in such special case is impractical, and a full statement of the qualifications and attainments of the persons designated to fill such positions if the competition requirements are waived. Suspension of the competition requirement pursuant to this rule is in the sole discretion of the Civil Service Commission.

An "emergency appointment" is an unclassified appointment to a position to meet an emergency situation, and limited to a maximum of 120 calendar days. Such emergency appointment is authorized only when the Civil Service Commission determines that an emergency exists, based upon the submission by the appointing authority of documentation establishing an emergency. Successive appointments of an emergency nature are prohibited. Emergency service shall not count as part of the probationary period. All emergency appointees must meet the minimum requirements for the positions to which they are appointed.

Promotions
Whenever there is a vacancy in a position having a classification above the lowest grade in the series, the Commission shall determine the method for filling the position. The cooperation of the department heads may be sought in making this decision. To the extent practicable all promotions shall include a competitive examination. The competitive examination shall include, but not be limited to, a written examination.

If a vacancy exists in a promotional position, but it is determined by the Civil Service Commission that it is not feasible to conduct an examination, the Commission may authorize the appointing authority to nominate an eligible employee for promotion without competition. Such promotion without competition shall be substantiated by written documentation from the appointing authority showing that the duties performed by the person nominated have been in actual preparation for the higher position, and that such person is entitled to promotion by reason of effective performance and appropriate qualifications. Such promotion shall be deemed a provisional appointment subject to displacement when a written promotional examination is given.

The final grade of an applicant in a promotional examination shall be determined by adding to the passing score obtained on the competitive examination additional points for:

(a) Years of full-time continuous service with the City only based upon one percentage (1%) point of the score received on the examination for each full year of the first four years of full-time continuous service, and six-tenths of one percentage (.6%) point of the score received on the examination for each full year of full-time continuous service on the next ten years of service; and

(b) Credit for performance based upon determination of the average of each candidate's three most recent performance evaluations and adding one-quarter percent (1/4%) of the score received on the examination for each point above the minimum acceptable performance evaluation score as determined by the Commission, up to a maximum of eight percent (8%). In no case shall the addition of seniority and/or efficiency points be used to achieve a passing score on an examination for promotion.

Certification
Following any classification change, certified employees shall either retain certified status or be changed to provisional status. A provisional employee who receives a classification change shall retain provisional status unless selected from an eligible list.

(a) A certified employee receiving a classification change shall retain certified status if the change is to a classification within the same classification series.
(b) If a provisional employee who did not retain certified status following a classification change receives a probationary reduction or is voluntarily demoted to a classification in which he served and was certified within the prior two year period, the employee's prior certified status in that classification shall be restored.
(c) Whenever the Civil Service Commission changes the classification plan, certified employees shall retain certified status in the same or a similar classification in the new classification plan.
