157.10 APPEALS.
   (a)   Pursuant to these rules and the Personnel Policy Manual for the City, the Civil Service Commission shall hear appeals, as provided by law, of employees in the classified service from final decisions of appointing authorities relative to reduction in pay or position, job abolishments, layoff, suspension, discharge, assignment or reassignment to a new or different position classification, or refusal of the appointing authority, or anybody authorized to perform his functions, to reassign an employee to another classification or to reclassify his position pursuant to a job audit under Section 157.07. The Commission may affirm, disaffirm or modify the decisions of the appointing authorities, and its decision is final. The Commission shall not be deprived of jurisdiction to hear an appeal due to the failure of an appointing authority to file its decision with the Commission. Any final decision of the appointing authority not filed in the manner provided in these rules shall be disaffirmed.
 
   (b)   The Commission shall hear appeals, as provided by law, of appointing authorities from final decision of the Commission relative to the classification or reclassification of any position or positions in the classified civil service under the jurisdiction of such appointing authority; the Commission may affirm, disaffirm or modify its decision, and its decision is final.
 
   (c)   The Commission shall serve as the Board of Appeals in the case of suspension, transfer, reduction, removal or in giving or grading of competitive examinations for all classified employees. In the case of suspension, the Department Head shall certify in writing to the City Manager the fact of the suspension and an explanation of cause. The City Manager, within five days receipt of the statement of suspension, shall conduct an investigation as to cause, and shall render judgment thereon. During the investigation, the City Manager shall have the power to administer oaths and secure the attendance of witnesses and the production of books and papers. Should the charge be sustained, the judgment of the City Manager may be either suspension, reduction or removal. This decision may be appealed to the Commission pursuant to these rules.
