(a) Pursuant to Ohio R.C. 124.271, an employee who serves in provisional status in the same classification for a period of two continuous years may be eligible for automatic certification, provided that an open competitive examination has not been given during the two year eligibility period for the classification for which the employee seeks certification.
(b) For purposes of determining whether or not two continuous years of service in the same classification has elapsed, any separation from municipal service, other than a layoff, lasting longer than thirty consecutive calendar days, constitutes a break in continuous service. An employee who is laid off and then returns to municipal service within one year from the date of the layoff is credited with continuous service exclusive of the period actually spent in layoff status. Up to a maximum of six months shall be credited for time spent on approved leaves of absence whether or not such leaves are paid or unpaid.
