(a) (1) No licensee under this article shall maintain a junk yard or junk shop, auto salvage yard or scrap metal yard or any other business unless such business is carried on entirely inside a building or unless the premises on which the business is conducted are entirely enclosed (except for gates or doors for ingress and egress) by a fence, at least eight (8) feet in height, provided that on any part of such premises along or visible from residential property or a public highway or street such fence and any doors and gates shall be of solid masonry, steel or wood construction.
Gates and doors for access to the premises shall swing inward and shall be designed so that operations conducted on the premises are not visible from the adjoining street. All gates and doors shall be closed when the premises are not open for business.
All fence designs and material specifications shall be submitted in writing to the Building and Safety Inspections Division for review and approval before the permit required by § 17-2 will be issued, and shall thereafter be installed in a conventional manner according to the requirements of the City Code.
Barbed wire shall be installed on the top of such fences on arms or supports projecting over the private property side of the fence at least eight (8) feet above the adjacent grade.
(b) Where, owing to special conditions, a literal enforcement of the requirements for solid fences along highways, streets and residential property will result in unnecessary hardship or involve practical difficulties, the Department of Building and Safety Inspection may, in specific cases, vary or modify the time for application thereof, imposing such conditions or limitations it finds necessary to promote the public health, safety and general welfare, subject to the approval of the City Council.

(a) All walls and fences of businesses licensed under this article shall be maintained in a neat, substantial manner.
No junk, secondhand property, salvage or scrap metal or other materials shall be permitted to lean on or touch any such wall or fence, nor to be in front or attached to or suspended on any such wall or fence on the building thereof, nor permitted, along any highway or street or residential property, to be piled within two (2) feet from the base of the wall or fence nor in excess of the enclosing wall or fence, and in no case to be piled in a manner likely to endanger a person or persons using any such highway or street, or be visible from an adjoining street or highway or residentially zoned property.
Scrap metal, stored in connection with reprocessing operations may exceed the height of the walls or fences required under this article, provided, that said material is no closer than 25 feet to the surrounding fence or wall along any highway, street or residential property.
(b) The material located in or on the premises of any business licensed under this article shall be so arranged so that safe aisles, driveways and uniform passageways provide reasonable access to all parts of the premises for inspection by law enforcement officers or firefighting operations.
(c) The layout, arrangements and construction of buildings and premises used in connection with businesses licensed under this article shall comply with the applicable requirements of the City Code and shall be provided with suitable fire protection and extinguishment equipment.
(d) Maintenance of premises, burning on premises. All premises used in connection with a business licensed under this article shall be maintained in a clean, sanitary and neat condition, and so maintained so that rats, vermin, and fire hazards are as far as practicable reduced to a minimum. No junk, secondhand property or parts thereof shall be burned on such premises unless a valid permit from the Fire Marshal and the Michigan Department of Natural Resources have been issued and are in force.
All businesses licensed under this article shall comply with all laws and regulations promulgated by the Environmental Protection Agency (EPA) and the Michigan Department of Natural Resources.

OUTDOOR COLLECTION SITE. Any location within the City of Flint which is in plain view or opened for aerial observation including any space partially or wholly surrounded by a fence or a wall either:
(1) Where thirty (30) or more but fewer than five hundred (500) scrap tires are accumulated for a period of 24 hours or longer on real property which is not adjacent to a retail tire operation as provided in subdivision (2); or
(2) Where thirty (30) or more but fewer than one thousand five hundred (1,500) scrap tires are accumulated for a period of 24 hours or longer on real property which is adjacent to and owned or leased by a person who is in the business of retail tire sales.
PERSON. Every natural person, firm, partnership, association or corporation and their successors.
SCRAP TIRE. A tire that is no longer being used for its original intended purpose.
STORAGE. The maintenance or possession of scrap tires in an outdoor collection site but excluding those tires which are affixed to any motorized vehicle.
TIRE. A continuous solid or pneumatic rubber covering which encircles a wheel whether new, used, or scrap, and was manufactured for use in the operation of any motorized vehicle.
VEHICLE. Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, including, but not limited to, all terrain vehicles, automobiles, farm implements, jeeps, motorcycles, recreational vehicles, tractors, trucks, and vans, but excepting devices propelled exclusively by human power or used exclusively upon stationary rails or tracks.

Unless in compliance with the requirements of this division, persons are prohibited from owning, maintaining, leasing, operating or managing any outdoor collection site for the storage of any scrap tires either:
(a) Where thirty (30) or more but fewer than five hundred (500) scrap tires are accumulated on real property which is not associated with a retail tire operation; or
(b) Where thirty (30) or more but fewer than one thousand five hundred (1,500) scrap tires are accumulated on real property which is adjacent to and owned or leased by a person who is in the business of retail tire sales.

Persons are prohibited from the storage of scrap tires in an outdoor collection site without obtaining an annual permit issued by the Building and Safety Inspections Division. When applying for this permit, such persons shall submit a completed scrap tire outdoor collection site registration form; the proper fee established by ordinance; and a scaled set of blue prints or drawings of the outdoor collection site including the dimensions and the geographic positions of all adjacent streets, property lines, private water supply lines, fencing, buildings, and other objects.

Prior to issuance of any permit under this division, persons, who utilize an outdoor collection site for the storage of scrap tires, shall deliver to the City of Flint - Risk Management Department a commercial liability and property damage insurance policy naming the City an additional insured and providing for payment in the amount of fifty thousand dollars ($50,000.00) for each occurrence and one hundred thousand dollars ($100,000.00) aggregate for any liability imposed by law.

Prior to issuance of any permit under this division, persons, who utilize an outdoor collection site for the storage of scrap tires, shall deliver to the City of Flint - Risk Management Department a surety bond in favor of the City to provide for payment in the amount of five thousand dollars ($5,000.00) for the collection, transportation and/or disposal costs incurred when the Building and Safety Inspection Division determines that such tires are to be removed because a public emergency exists at the outdoor collection site including, but not limited to, the abandonment of the outdoor collection site by the persons utilizing the same for storage.

Where an outdoor collection site is utilized for storage, scrap tires shall be stacked in separate piles. Each pile shall be separated from every other pile by an aisle which shall be a minimum of twenty (20) feet in width. Each pile shall be of uniform design configuration which is not more than ten (10) feet in width, twenty (20) feet in length, and ten (10) feet in height.
