§ 39-25 SAME — PERMIT REQUIRED; FEE; REVOCATION.
   Where large moveable receptacles are authorized, they shall not be installed until a permit has been obtained from the Department of Public Works and Utilities. A permit shall be issued only after payment of a fee as specified in Chapter 26 of this Code. Sufficient receptacles shall be provided to hold two weeks’ accumulation of refuse. Any permit can be revoked for cause by the Department of Public Works and Utilities.

§ 39-26 LOCATION.
   (a)   Receptacles shall be conveniently accessible for collection service and for all users. All portable receptacles for garbage or rubbish shall be located in the rear of the premises except on collection day or the evening previous to date of collection. In residential areas, receptacles for refuse shall be placed in a location easily accessible to the collector, as close as possible to the driveway and within approximately five feet of the curb within the area between the sidewalk and curb or edge of the traveled portion of the public right-of-way.
   (b)   Any person who shall establish to the satisfaction of the City Administrator, that he or she suffers from a physical disability such as to make it impossible to move the receptacle to the location above specified, shall not be required to place the receptacle in such location for removal and the receptacle shall be picked up in a reasonable accessible location outside of the residence of the disabled person. In order to be entitled to the service above specified, a disabled person shall make application to the City Administrator, and shall, if required by the City Administrator, present medical evidence in support of the claim of disability. In the event there is a dispute relative to the existence of the disability the City Administrator shall have the right to request a medical evaluation by the City Physician. The City Administrator shall have the right to promulgate reasonable rules and regulations in order to implement and carry out the above procedures.
   (c)   Commercial and multiple dwellings’ refuse shall be located as indicated on the permit issued for use of the containers and receptacles.

§ 39-26.5 PENALTY — DESIGNATION AS MUNICIPAL CIVIL INFRACTION.
   Any person, association or corporation found in violation of §§ 39-19, 39-20, 39-20.1 or 39-21 shall be found responsible of a municipal civil infraction pursuant to §§ 1-10 through 1-21.

DIVISION 4. COLLECTION
§ 39-27 PRIVATE WASTE COLLECTIONS.
   It shall be unlawful for any person other than employees of the Department of Public Works and Utilities, licensed garbage and refuse collectors or other authorized persons, to disturb, collect or in any other manner interfere with garbage and rubbish placed in the streets, alleys and public places for collection by the City authorities, or to interfere in any manner with any garbage and rubbish receptacles. The Director of Public Works and Utilities shall have the right to specify the time and method of storage, collection and disposal by any authorized collector.

§ 39-28 DOMESTIC WASTE.
   Domestic waste shall be collected without charge; except, that waste material scattered on the ground or placed in other than proper receptacles as specified may be classed as commercial waste and may be charged for at special rates to be determined by the Director of Public Works and Utilities and approved by the City Council.

§ 39-29 COMMERCIAL WASTES.
   The Department of Public Works and Utilities shall collect garbage or rubbish, or both, from a commercial establishment, trailer park or apartment building, subject to payment therefor as provided. Nothing herein shall be construed to prohibit the party responsible for creating commercial waste from entering into a contract with an authorized private collector or otherwise disposing of the waste; provided, that it is stored and disposed of in such a manner as to create no nuisance.
