DIVISION 3. RECEPTACLES
A proper and sufficient number of portable receptacles for the storage of garbage and of rubbish between collections shall be provided by each family residing in a single-family or in a two-family dwelling. It shall be the duty of the occupants to maintain the receptacles in good repair and in a clean and sanitary condition and to store rubbish and garbage properly therein.

In the case of a building housing more than two families, the owner, lessee or agent of the premises shall provide for each family a proper and sufficient number of receptacles for the storage of garbage and of rubbish between collections. The owner, lessee, agent or a caretaker of the receptacles shall maintain in good repair and in a clean and satisfactory condition. Unless a permit for a stationary or large moveable receptacle has been issued, these receptacles shall be of a portable type.

(a) In the case of a business, all trash collection and storage areas not located within a fully enclosed building or structure shall be completely enclosed by a solid wall, solid fence, dense living hedge and/or solid gate not less than six feet in height.
(b) This section shall not apply to any of the following:
(1) Businesses located in the Downtown Development District of the City as defined in § 2-125 of this Code of ordinances; or
(2) Any business that is located in the E Heavy Commercial — Limited Manufacturing District, F Intermediate Manufacturing District or G Heavy Manufacturing District zoning classification, as defined in Chapter 50 of this Code of ordinances.

After due notice, in a manner and form prescribed by the Director of Public Works and Utilities, has been given to the responsible party to dispose of defective or illegal waste receptacles and outdoor trash burners, they may be collected as rubbish by the Department of Public Works and Utilities if they remain on public property. No defective or illegal receptacle shall be used for storage of garbage or rubbish.

(a) (1) All discarded property, junk, garbage, and rubbish shall be placed in a bag or approved receptacle for collection.
(2) All discarded property, junk, garbage and rubbish placed in a receptacle shall first be placed into a bag.
(b) For purposes of this section, an
APPROVED RECEPTACLE OR BAG shall be a container or bag no larger than 32 gallons designed for the purpose of holding discarded property, junk, garbage and rubbish.
(c) Discarded property, junk, garbage or rubbish shall not be placed at the designated place for collection more than 12 hours before 7:00 a.m. of the day scheduled for collection.
(d) It shall be unlawful for any person to place more than 20 approved receptacles or bags along with three pieces of furniture at the place designated for collection unless an appropriate permit has been acquired from the City of Flint Treasurer’s office.
(1) The cost of the permit shall be designated in the master fee schedule.
(2) The permit shall be in the form of a sticker that shall be conspicuously placed on each item which exceeds the 20 receptacle/bag limit.
(e) Any item that does not fit within a bag within a receptacle must be affixed with a permit.
(1) Each item that exceeds the limit set forth in subsection (d) that is placed in the designated place for collection without a permit shall constitute a separate violation.
(2) Each day that a violation of this section shall exist shall constitute a separate violation.

All receptacles for the storage of garbage, rubbish and ashes shall be of a portable type at the following building occupancies:
(a) For storage of garbage in dwellings containing four families or more; and
(b) For storage of garbage from an individual commercial establishment whose monthly bill for garbage collection from the City establishes the need for nine or more portable garbage cans or 20-gallon capacity between collections.
