(a) Except as provided in OAC 4101:2-1-13(B), no person, firm or corporation shall erect, construct, enlarge, alter, repair, move or demolish a building or structure, or install any equipment or other appurtenances the installation of which is regulated by this OBBC or Building Code, or cause the same to be done, without first making application to the Commissioner and obtaining a permit therefor unless OBBC or this Building Code specifically provides that such work may be done without a permit.
(b) Separate application shall be made to the Commissioner and separate permits obtained for electrical work, plumbing, elevators, moving stairways, power operated dumbwaiters, heating devices and installations, mechanical refrigeration systems, outdoor signs and display structures, and for such other equipment and appurtenances for which separate permits are required by OBBC or this Building Code, or by the rules for applications and permits issued by the Commissioner.
(c) Separate applications shall be made to the Fire Chief and separate permits obtained from the Chief for the storage, use or handling of combustibles, hazardous chemicals, explosives, flammables, and other dangerous substances, articles, compounds, or mixtures, and for the installation or alteration of required fire alarm systems and required fire- extinguishing equipment.
(a) Form.
(1) An application for a permit required under OBC or Section 3105.01 signed by the owner or his or her authorized agent, shall be filed with the Commissioner on a form furnished by him or her and shall provide such information as may reasonably be required by the Commissioner for an intelligent understanding of the proposed work.
(2) When separate permits from the Fire Chief are required in connection therewith, the applications for such separate permits shall be filed with the Commissioner who shall promptly transmit such applications and the relevant plans and specifications for action by the Division of Fire.
(3) If application is made by a person other than the owner in fee, the Commissioner may require that it be accompanied by a duly verified affidavit of the owner in fee or the person making the application, stating that the proposed work is authorized by the owner in fee, and that the person making the application is authorized to make such application.
(4) When separate permits from the Division of Water are required in connection therewith, the application for a permit required under OBC or Section 3105.01 shall be accompanied by a site plan. The Commissioner shall promptly transmit such site plan to the Division of Water to determine the location of any previously installed service connections and to make arrangements to plug or cap such service connections pursuant to Section 531.07.
(b) Plans and Specifications.
(1) When required by the Commissioner, two (2) or more copies of plans and specifications shall accompany each application. Plans shall be drawn to scale with sufficient clarity to indicate the nature and extent of the work proposed. Such plans and specifications together shall contain information sufficient to indicate that the work proposed will conform to the provisions of this Building Code and all other applicable laws, ordinances, rules and regulations. Such information shall be specific, and OBC or this Building Code shall not be cited as a whole or a part, nor shall the term “legal” or its equivalent, be used as a substitute for specific information. Each set of plans and specifications shall give the address of the work and the name and address of the owner and of the person who prepared them.
(2) The Commissioner may require a plot plan by a qualified surveyor showing the topography of the site, and the location of the proposed building or structure on the site or lot, and of buildings and structures on adjoining property. He or she may also require details, computations, stress diagrams, and other data necessary to describe the construction and basis for calculations. (See Section 327.02(e) of the Zoning Code.)
(3) When plans contemplate structural changes or structural work affecting public health or safety, the Commissioner may require that they shall be prepared by and bear the seal of a registered architect or registered professional engineer, and he or she may require that they be accompanied by an affidavit of such registered architect or registered professional engineer stating that he or she has supervised the preparation of the plans, and that to the best of his or her knowledge and belief the structure, if built in accordance with the plans, will conform to OBC and this Building Code, except as specifically noted otherwise.
(4) When approved plans and specifications are not required, work shall be installed in accordance with the material manufacturer’s installation requirements for the conditions that exist and work shall be performed in the manner intended.

(a) The Commissioner shall examine or cause to be examined each application for permit and the plans, specifications and computations, filed therewith, and with the assistance of other departments and divisions of the City having jurisdiction, shall ascertain by such examination whether the construction indicated and described is in accordance with the requirements of this OBBC and Building Code and other pertinent laws, ordinances, rules and regulations. When permits are required from other administrative officers or agencies, he or she shall promptly transmit or cause to be transmitted all pertinent data for action by such administrative officers or agencies, and shall be the coordinating officer in the handling of such applications, plans, specifications, data and permits.
(b) If the plans submitted conform to the laws as to egress, type of construction, and general arrangement, and are accompanied by drawings showing the structural design and by a statement that the plans and design conform to the requirements of law as to strength, stresses, loads, and stability, and are filed and sworn to by a registered architect or registered professional engineer, and separate permits are secured as required by Section 3105.01, the Commissioner may without further examination accept such affidavit; provided that the architect or engineer who made such affidavit agrees to submit to the Commissioner on the completion of the building or other structure, a certification that the structure has been erected in accordance with the approved plans and the structural provision of OBBC and this Building Code, and that all required inspections and approvals have been secured.
(a) Approval.
(1) The Commissioner and other administrative officers having jurisdiction shall act upon an application for a permit without unreasonable or unnecessary delay. If the administrative officer having jurisdiction is satisfied that the work described in an application for permit and the plans filed therewith conform to the requirements of OBBC and this Building Code and other applicable laws, ordinances, rules and regulations, he or she shall issue a permit therefor to the applicant upon payment of the fee, if any, prescribed by ordinance.
(2) When the administrative officer having jurisdiction issues a permit, he or she shall endorse in writing or stamp on both sets of plans and specifications “DRAWINGS ON WHICH PERMIT WAS ISSUED”. Such plans and specifications shall not be changed, modified or altered in any manner affected by this Building Code without authorization from the administrative officer having jurisdiction, and all work shall be done in accordance with stamped plans and specifications.
(b) Deposit or Bond. When any work is to be done beyond the street or alley line or on or above public property which may cause the City to sustain loss, damage or injury to public property, or to be put to expense in correcting conditions resulting therefrom, the Director of Public Service may require the person, firm or corporation proposing to do such work, or the owner for whom such work is to be done, to post a deposit or furnish a bond in the form determined by the Director of Law and in the amount determined by the Director of Public Service, to indemnify the City against any costs that may be incurred and any loss, damage, or injury that may be sustained by the City because of such work, and as guarantee of compliance with OBBC and this Building Code and other applicable law, ordinances, rules and regulations. Such required deposit or bond shall be posted before any permit is issued for work beyond the street or alley line or on or above public property.
(c) Amendments. Nothing in this section shall prohibit the filing of amendments to an application, or to the plans and specifications accompanying such application, at any time before the completion of the work. However, such amendments shall be submitted and approved before any work proposed under such amendment is begun. Such amendments, after approval, shall be filed with and deemed a part of the original application.
(d) Disapproval. If the applications for a permit, or the plans and specifications filed therewith, or the application for approval of an amendment, describes work which does not conform to the requirements of OBBC and this Building Code or other applicable laws, ordinances, rules or regulations, or does not contain sufficient information, the administrative officer having jurisdiction shall return the plans and specifications to the applicant with his or her refusal to issue such permit or approval.
