§ 3141.01 Scope and Application
   The provisions of OAC Chapter 4101:2-21 and the Ohio Elevator Code as set forth in OAC Chapters 4101:5-1 to 4101:5-9 and this chapter shall apply to the construction, alteration, maintenance, operation, inspections, and tests of elevators, dumbwaiters, moving stairways, amusement devices, and special devices herein defined as special equipment.
§ 3141.02 Definitions
   (a)   In the application and interpretation of this chapter, the definitions included in the Ohio Elevator Code shall apply.
   (b)   The following additional definitions shall also apply:
      (1)   “Alteration” of an elevator, dumbwaiter, or moving stairway means any change made to an existing installation, including any change to hoistway enclosures, doors or gates, other than repairs or replacements of damaged, worn or broken parts made incidental to maintenance.
      (2)   “Amusement device” means any manually or power operated device used to convey persons in any direction as a form of amusement.
      (3)   “Existing installation” of an elevator, dumbwaiter, moving stairway, amusement device or special equipment means an installation completed prior to June 27, 1949 or one for which the application for a permit was filed with the Commissioner prior to June 27, 1949.
      (4)   “New installation” of an elevator, dumbwaiter, moving stairway, amusement device, or special equipment means a complete elevator, dumbwaiter, moving stairway, amusement device, or special equipment installation, the application for a permit for which is filed with the Commissioner after June 27, 1949.
      (5)   “Special equipment” means any permanently or semi-permanently located device, manually or power operated, used for moving or lifting materials or persons, and not considered an elevator, dumbwaiter, moving stairway or amusement device.
      “Special equipment” includes devices inclined at an angle for carrying one (1) or two (2) persons, or for carrying materials, but which are not included under elevators or moving stairways; manhoists; lift bridges; elevators which are used only for handling building material and workmen during construction; elevators of a capacity exceeding thirty thousand (30,000) pounds and a platform area exceeding three hundred (300) square feet when suspended by cables near each corner of the hoistways and at additional positions; stage and orchestra lifts; belt, bucket, scoop, roller, or similarly inclined or vertical freight conveyors; telescopic ash hoists; tiering or piling machines; skip hoists and wharf ramps; and similar apparatus.
