§ 3105.20 Determining Value of Destroyed Parts
   In determining the proportionate value of a destroyed part of a building or other structure, or of additions, alterations or repairs made to a building or other structure, all parts, whether existing, new, or destroyed, and including plumbing, heating and ventilating equipment, electrical wiring and equipment, and other necessary fixed equipment, shall be valued at costs current at the time of evaluation. However, parts which do not serve a required purpose such as decorative painting, molded or cast plaster decorations, and wall, floor or ceiling finishes intended for comfort or enhancement, shall not be included in such valuation.
§ 3105.21 Sign Measurement Standards
   Sign face area, sign height and sign location, as regulated in OBBC and this Building Code, shall be measured according to the following standards.
   (a)   Sign Face Area. Standards to compute the amount of sign face area permitted by these regulations are herein established as follows:
      (1)   Measurement of Sign Face Area.
         A.   Panel Signs. Sign face area shall be measured to include the surface area of the smallest single rectangle enclosing the sign panel. For two (2) sided free-standing signs, which conform to the standards of OBBC and Chapter 3113 of this Building Code, only one (1) side shall be included in the measurement. For any free-standing sign, measurement of sign face area shall also include any portion of the structural supports which extends above the base of the sign panel. However, the entire structural support shall be included in the measurement if such supports are designed and used to convey part of the sign’s message.
         B.   Nonpanel Signs. Sign face area shall be measured to include the surface area of the smallest single rectangle enclosing the letters or characters of the sign.
      (2)   Measurement of Building Frontage. The frontage of a building shall be the width of the facade(s) of the building, excluding any roof overhang or non-bearing decorative walls, which faces the principal street or contains the main entrance. If a building is divided into units, the building unit frontage shall be the width of that unit as measured from the party wall centerlines, on the frontage of the building.
      (3)   Measurement of Temporary Window Sign Coverage. In determining the percentage of window area covered by temporary signs, each facade or side of the building shall be considered separately. Window area shall be measured to include all windows and the glass portions of doors but shall exclude all such area covered by permanent signs or other relatively permanent material.
   (b)   Sign Height. The height of freestanding signs shall be measured from the base of the sign at its point of attachment to the ground to its topmost element. However, if the support of a free-standing sign is attached to a wall or other man-made base, including a graded earth mound, the sign height shall be measured from the grade of the nearest street, drive or parking area, as determined by the Commissioner of Building and Housing.
   (c)   Sign Location. In determining the location of signs in relation to lot lines, including district and street right-of-way lines, distances shall be measured from the vertical projection of the lot line to the closest point on the sign. For corner lots, two (2) lot lines shall be considered street right-of-way lines.
§ 3105.22 Fee Payment Procedure
   The Commissioner shall by rule establish the procedure for payment of fees for inspections and for certificates of approval, operation, and occupancy. However, no certificate shall be issued until the required fee has been paid. All fees shall be paid to the City Treasurer.
§ 3105.23 Minimum Fee for Permit
   The minimum fee for any required permit shall be ten dollars ($10.00). Where no permit fee is prescribed by this chapter, the fee for a required permit shall be twenty dollars ($20.00).

§ 3105.24 Refund of Permit Fees
   Whenever the work for which a permit has been issued has been abandoned and is not to be done, such permit may be returned to the Commissioner for cancellation and after a deduction of thirty dollars ($30.00) from the permit fee has been made, one-half (1/2) of the balance of the permit fee, if any, shall be refunded by the City Treasurer on certificate from the Commissioner.
§ 3105.25 Schedule of Permit Fees
   When fees are calculated on an estimated construction or repair cost, the value of work shall include all structural, electrical, plumbing and HVAC, interior finish, normal site preparation including excavation and backfill, overhead and profit. Architectural/Engineering fees, costs of land and off- site costs need not be included. The value estimate of the proposed work may be determined by the Department of Building and Housing in accordance with generally accepted methods of estimating as prescribed by BOCA or the R.S. Means Cost Data Service that is effective on the date application is made for the permit.
   NOTE: Other permit fees, such as for electrical, plumbing, HVAC, elevators and plan processing are separate.
   Except for permit fees for work performed on one (1), two (2), three (3) family dwellings, their accessory structures and other miscellaneous items listed in division (E) of RC 3781.10, the permit fees herein include the required surcharge pursuant to division (E) of RC 3781.10.
   For permit and plan examination fees for work performed on one (1), two (2), or three (3) family dwellings or their accessory structures, the permit fees do not include the required one percent (1%) surcharge. For permits issued for that work, the required surcharge shall be calculated on the final cost of each permit issued and shall be separately itemized.

§ 3105.26 Schedule of Inspection Fees
   There shall be no separate inspection fees except as provided in Section 3105.27 and this section:
   (a)   Special Inspections.
      (1)   Whenever an inspection has been requested and upon inspection the work is not found to be ready for inspection, or where the address given in the application for permit is faulty or inaccurate, there shall be charged a fee of one hundred dollars ($100.00) for each inspection.
      (2)   For inspections required outside of regular working hours (special events, witness testing of special equipment, etc.) the fee shall be one hundred dollars ($100.00).
      (3)   Whenever a special inspection, not a routine inspection of work being done under a permit, is requested, there shall be an inspection fee as follows:
         Dwelling units at twenty dollars ($20.00), minimum fifty dollars ($50.00);
         Other structures at sixty dollars ($60.00) per story.
      (4)   Whenever an inspection is made after the compliance date stated on a Notice of Violation of the Building Code, the Housing Code or the Zoning Code or after a compliance date determined by a court of competent jurisdiction to determine whether the violation has been remedied and the violation has not been remedied, or an additional permit is obtained for work previously permitted and the original permit has expired or was appropriately voided, there shall be charged a fee of one hundred dollars ($100.00) for each inspection, except that this fee shall not apply to one (1) family and two (2) family owner-occupied dwelling structures.
   (b)   Annual Building Inspections.
      (1)   Eating Places: sixty-five ($65.00) per occupancy;
      (2)   Drinking Places: sixty-five ($65.00) per occupancy;
      (3)   Annual Inspections under Licensing Requirement: sixty-five ($65.00) per occupancy,
   (c)   Late Fee, for Work Started Prior to Permit Issuance.
      (1)   Within seventy-two (72) hours of notification: Min one hundred dollars ($100.00) + twenty-five percent (25%) of required permit fee;
      (2)   After seventy-two (72) hours: Min two hundred dollars ($200.00) + twenty-five percent (25%) of required permit fee.
   (d)   Payment of charges for inspections enumerated above shall be made before any additional permits will be issued to the permit holder.
