§ 3105.03 Permit Application Review; Plan Affidavit
   (a)   The Commissioner shall examine or cause to be examined each application for permit and the plans, specifications and computations, filed therewith, and with the assistance of other departments and divisions of the City having jurisdiction, shall ascertain by such examination whether the construction indicated and described is in accordance with the requirements of this OBBC and Building Code and other pertinent laws, ordinances, rules and regulations. When permits are required from other administrative officers or agencies, he or she shall promptly transmit or cause to be transmitted all pertinent data for action by such administrative officers or agencies, and shall be the coordinating officer in the handling of such applications, plans, specifications, data and permits.
   (b)   If the plans submitted conform to the laws as to egress, type of construction, and general arrangement, and are accompanied by drawings showing the structural design and by a statement that the plans and design conform to the requirements of law as to strength, stresses, loads, and stability, and are filed and sworn to by a registered architect or registered professional engineer, and separate permits are secured as required by Section 3105.01, the Commissioner may without further examination accept such affidavit; provided that the architect or engineer who made such affidavit agrees to submit to the Commissioner on the completion of the building or other structure, a certification that the structure has been erected in accordance with the approved plans and the structural provision of OBBC and this Building Code, and that all required inspections and approvals have been secured.
§ 3105.04 Permit Approval Procedure; Insurance and Bond
   (a)   Approval.
      (1)   The Commissioner and other administrative officers having jurisdiction shall act upon an application for a permit without unreasonable or unnecessary delay. If the administrative officer having jurisdiction is satisfied that the work described in an application for permit and the plans filed therewith conform to the requirements of OBBC and this Building Code and other applicable laws, ordinances, rules and regulations, he or she shall issue a permit therefor to the applicant upon payment of the fee, if any, prescribed by ordinance.
      (2)   When the administrative officer having jurisdiction issues a permit, he or she shall endorse in writing or stamp on both sets of plans and specifications “DRAWINGS ON WHICH PERMIT WAS ISSUED”. Such plans and specifications shall not be changed, modified or altered in any manner affected by this Building Code without authorization from the administrative officer having jurisdiction, and all work shall be done in accordance with stamped plans and specifications.
   (b)   Deposit or Bond. When any work is to be done beyond the street or alley line or on or above public property which may cause the City to sustain loss, damage or injury to public property, or to be put to expense in correcting conditions resulting therefrom, the Director of Public Service may require the person, firm or corporation proposing to do such work, or the owner for whom such work is to be done, to post a deposit or furnish a bond in the form determined by the Director of Law and in the amount determined by the Director of Public Service, to indemnify the City against any costs that may be incurred and any loss, damage, or injury that may be sustained by the City because of such work, and as guarantee of compliance with OBBC and this Building Code and other applicable law, ordinances, rules and regulations. Such required deposit or bond shall be posted before any permit is issued for work beyond the street or alley line or on or above public property.
   (c)   Amendments. Nothing in this section shall prohibit the filing of amendments to an application, or to the plans and specifications accompanying such application, at any time before the completion of the work. However, such amendments shall be submitted and approved before any work proposed under such amendment is begun. Such amendments, after approval, shall be filed with and deemed a part of the original application.
   (d)   Disapproval. If the applications for a permit, or the plans and specifications filed therewith, or the application for approval of an amendment, describes work which does not conform to the requirements of OBBC and this Building Code or other applicable laws, ordinances, rules or regulations, or does not contain sufficient information, the administrative officer having jurisdiction shall return the plans and specifications to the applicant with his or her refusal to issue such permit or approval. When requested by the applicant, such refusal shall be in writing, and shall contain the reasons therefor.
§ 3105.05 Plans Required at Work Site
   One (1) set of stamped plans, specifications and computations shall be retained by the administrative officer having jurisdiction and one (1) set of stamped plans and specifications shall be returned to the applicant. The latter set shall be kept at the site of the work at all times during which the work authorized thereby is in progress and shall be open to inspection at all reasonable times by the administrative officer or officers having jurisdiction and their authorized representatives.
