8-37-9: INSPECTION OF RECORDS:
Any records, books, computer generated records, video surveillance records, or digital photographs taken, as well as every article or other thing of value purchased or received on consignment shall at all times be open to inspection by the Chief of Police or any sworn law enforcement officer during the licensee's business hours and shall be maintained for a period of three (3) years after the date on which the record was prepared. 8-37-10: TRANSACTIONS WITH PROHIBITED PARTIES:
   A.   It shall be unlawful for any licensee, or its agent or employee, to purchase any article or receive on consignment any article from a person under the age of eighteen (18) years, or the ownership of which is claimed by such minor, or which may be in the possession or control of any minor without the written consent of such minor's parent or legal guardian. The consent must be signed by such minor's parent or legal guardian in the presence of the licensee or the licensee's employee or agent.
   B.   It shall be further unlawful for any licensee to purchase any article or receive any article on consignment from any person appearing to be intoxicated or under the influence of any drug or controlled substance or from any person known to have been convicted of theft, burglary, deceptive practices, robbery or armed robbery.
   C.   It shall be the duty of every licensee, or agent or employee thereof, to return any article purchased or received on consignment to the lawful owner of such article without the payment of the money paid therefor by the licensee, or any other cost or charge of any kind, in cases where such article has been stolen from or lost by its lawful owner. 8-37-11: VIOLATION PENALTY:
Any person violating any of the provisions of this article shall be fined not less than one thousand dollars ($1,000.00) for each offense. Each violation in regard to a separate transaction shall constitute a separate and distinct offense. (Ord. 16-019, 2-16-2016)

8-38-1: DEFINITIONS:
The words and phrases set forth below are hereby defined as follows for the purposes of this article:
LICENSEE: The operator of a massage establishment.
MASSAGE: A system of structure palpitation or movement of the soft tissue of the body or parts of the body, including but not limited to any method of pressure on, friction against, or stroking, kneading, rubbing, tapping, pounding, bathing, touching, binding, painting, irritating, or stimulation of external soft parts of the body with hands or with the aid of any manual, mechanical or electrical apparatus or appliance, with or without such supplementary aids as rubbing alcohol, liniments, antiseptic oils, powder, creams, lotions, soaps, ointments or other similar preparations commonly used in this practice.
MASSAGE ESTABLISHMENT: Any place of business where any person, for any consideration, engages in the practice of massage as defined above, but does not include any hospitals, nursing homes, facilities or offices at which a health care worker duly licensed by the State of Illinois provides, on an ongoing basis, professional health services to individuals.
MASSAGE THERAPIST: Any person who, for any consideration, engages in the practice of massage as above defined.
PERSONS: Any individual, copartnership, firm, association, joint stock company, corporation, or any combination of individuals of whatever form or character.
SEXUAL OR GENITAL AREA: The genital, pubic area, anus or perineum of any person, or the vulva or breasts of a female. (Ord. 18-382, 7-9-2018)
8-38-2: MASSAGE ESTABLISHMENT LICENSE - REQUIRED:
It shall be unlawful for any person to engage in, conduct or carry on, or to permit to be engaged in, conducted or carried on, upon any premises in the Village the operation of a massage establishment as defined in section 8-38-1 of this article without first having obtained a license from the Village. 8-38-3: CRIMINAL BACKGROUND CHECK; APPLICATION:
A criminal background check shall be required of applicants, unless the applicant is a licensed massage therapist by the State of Illinois. At the discretion of the Village Manager or the Manager's designee, fingerprints of the applicant and any employees may also be required as part of the initial application or the renewal of a license. Fingerprints shall be processed by the Illinois State Police in conjunction with the Federal Bureau of Investigation. The cost of fingerprinting shall be paid by the applicant and any applicable background check shall be without charge. An applicant shall also provide the Village with a list of services and corresponding prices and such other information as determined by the Village as part of a written application for the issuance or renewal of a license.
