The following words and phrases shall have the meanings, and are hereby defined, as follows:
ALCOHOL: | The product of distillation of any fermented liquid, whether rectified or diluted, whatever may be the origin thereof, and includes synthetic ethyl alcohol, but not including denatured alcohol or wood alcohol. |
ALCOHOLIC LIQUOR: | Any alcohol, spirits, wine and beer, and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer, and capable of being consumed as a beverage by a human being. The provisions of this chapter shall not apply to alcohol used in the manufacture of denatured alcohol produced in accordance with acts of Congress and regulations promulgated thereunder, nor to any liquid or solid containing one-half of one percent (0.5%), or less, of alcohol by volume. |
APPLICANT: | An individual, copartnership or corporation which seeks to be licensed under the provisions of this chapter. In the case of a "club", defined herein, applicant shall mean the officers, directors and person operating as manager, and in the case of a corporation, it shall mean the officers, directors, all persons owning directly or beneficially more than five percent (5%) of the stock of such corporation and the person operating as manager of the premises. |
ARTISANAL DISTILLED ALCOHOLIC LIQUOR: | Any alcoholic liquor produced by craft or artisanal distillers in small batches using traditional ingredients. The maximum production for a craft or artisanal distiller shall not exceed fifty thousand (50,000) proof gallons per year. Distillers who start with grain neutral spirits and through redistillation, substantially alter the original character of the original spirit, shall be considered craft or artisanal distillers for purposes of this definition. |
BAKESHOP: | Any public place kept, used, maintained, advertised and held out to the public as a place where cakes, cookies, pies, tarts, brownies, pastries, breads and other baked goods are produced on-site and sold for both on-site and off-site consumption, where the service of beer or wine is complementary and subsidiary to the sale and service of baked goods. Establishments that do not produce on-site all of the baked-goods which are sold on-site shall not qualify as a bakeshop. |
BAR: | A counter upon or over which alcoholic liquor is the principal commodity served for consumption by persons at such a counter. |
BAR BUSINESS ESTABLISHMENT: | A business establishment which has as its primary business, the sale of alcoholic beverages by the poured drink. Such a business within the Village would be limited to the hotel A-1 liquor license classification and its requirements as set forth in subsection 3-4-2A of this chapter. |
BEER: | A beverage obtained by the alcoholic fermentation of an infusion or concoction of barley, or other grain, malt and hops in water, and includes, among other things, beer, ale, stout, lager, porter and the like. |
BREWPUB: | A restaurant based establishment where beer is manufactured and stored on the licensed premises and sold at retail from storage tanks to nonlicensees, and sold in packages to importing distributors, distributors and nonlicensees in accordance with the brewpub license requirements contained in subsection 3-4-2D14 of this chapter and other alcoholic liquors which are sold at retail. |
BUSINESS AREAS: | The following geographic areas within Oak Park: Central Business Area (between Forest and Harlem Avenues, from North Boulevard to Ontario Street; on Oak Park Avenue from Ontario Street to Pleasant Street; on Lake Street from Euclid Avenue to Forest Avenue; between Home and Harlem Avenues, from Pleasant Street to South Boulevard); Chicago Avenue (Chicago Avenue from Austin Boulevard to Harlem Avenue); Harrison Street (Harrison Street from Austin Boulevard to Elmwood Avenue); Lake Street (Lake Street from Austin Boulevard to East Avenue; on Austin, south to South Boulevard; and on South Boulevard from Austin Boulevard to Elmwood Avenue); Madison Street (from Austin Boulevard to Harlem Avenue, including Washington Boulevard to Adams Street on Oak Park Avenue); North Avenue (North Avenue from Austin Boulevard to Harlem Avenue); Roosevelt Road (Roosevelt Road from Austin Boulevard to Harlem Avenue); South Town Oak Park (Oak Park Avenue from Van Buren Street to Lexington Street; Garfield Street from Euclid Avenue to Harlem Avenue; and Harrison Street from East Avenue to Grove Avenue). |
CATER: | To provide a supply of prepared food and service through prearrangement for group meetings, entertainment or special events, either on or off the business premises. |
CATERING HALL: | Any public place kept, used, maintained, advertised and held out to the public as a place where by prearrangement, events which involve the service of food may be catered. |
CLUB: | A not for profit corporation organized under the laws of this state, which shall have been in operation as a club for the three (3) years prior to applying for a liquor license and which shall have been organized solely for the promotion of some common object other than the sale or consumption of alcoholic liquors, kept, used and maintained by its members through the payment of annual dues, and owning, hiring or leasing a building or space in a building, of such extent and character as may be suitable and adequate for the reasonable and comfortable use and accommodation of its members and their guests. |
COFFEE HOUSE AND TEASHOP: | Any public place kept, used, maintained, advertised or held out to the public as a place where one of the primary business is the service of coffees, teas, and a limited selection of food items incidental thereto. |
CRAFT BEER: | Beer from a craft brewery that: a) produces less than fifteen thousand (15,000) barrels of beer annually (or 465,000 gallons); and b) produces a significant volume of either malt beers or beers that use adjuncts to enhance, rather than to lighten, flavor. |
CRAFT BREWERY: | An establishment that produces and serves craft beer where beer is manufactured on-site and stored on the licensed premises and sold at retail for both on-premises and off-premises consumption and other alcoholic liquors sold for on-premises consumption in accordance with the requirements set forth in subsection 3-4-2 D.15. of this chapter. Beer manufactured on-site may also be sold at wholesale to licensed entities as authorized by the Illinois liquor control act, 235 Illinois Compiled Statutes 5/1-1 et seq., as amended. |
ENTERTAINMENT: | The playing of live music by a person or persons using string, brass, reed, woodwind, percussion, electronic and digital instruments at a volume which does not create a public nuisance and/or performances by individuals and/or groups which may involve acting, singing, dancing, comedy and the reading and/or recital of poetry. |
ENTERTAINMENT CLUB: | A facility in which "entertainment", as defined herein, is provided to patrons of the establishment at all times when liquor is served, except during brief intermissions. |
GOURMET FOOD: | Food products which appeal primarily to connoisseurs of the delicacies of the table, i.e., fancy and party type food and drink. |
HARD LIQUOR: | Alcoholic liquor of thirty (30) proof or more and containing fifteen percent (15%) or more of alcohol by weight. |
HOTEL: | Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where a restaurant is located and sleeping accommodations are offered for adequate pay to travelers and guests, whether transient, permanent or residential, in which twenty five (25) or more rooms are used for the sleeping accommodations for transients. |
LIQUEURS: | A usually sweetened spirituous liquor (as brandy) flavored with fruit, spices, nuts, herbs or seeds. |
LIVE PERFORMANCE VENUE: | A facility for the presentation of live performances, including musical acts, theatrical plays or acts, stand-up comedy, magic, dance clubs, and disc jockey performances using vinyl records, compact discs, computers, digital music players or similar media. A live performance venue does not include an adult entertainment venue or adult use as defined in the Village's Zoning Ordinance. |
LOUNGE AREA: | That portion of a restaurant possessing a Class B-4 liquor license which contains a bar, tables and chairs and is set aside primarily for the service of alcoholic beverages by the poured drink without food, and which is operated in compliance with the B-4 liquor license requirements for such an area as set forth in subsection 3-4-2B4 of this chapter. |
MOVIE THEATRE: | A facility kept, used, maintained, advertised or held out to the public as a place within the Central Business Area as a place for the presentation of regularly scheduled motion pictures and films. |
PACKAGE LIQUOR SALES: | The sale or offering for sale at retail of alcoholic liquor, in the original package, and not to be consumed in whole or in part on the premises where sold. |
PREMISES: | Premises licensed under this chapter shall refer to that area for which a license has been issued to sell alcoholic beverages. Where more than one area for the sale of alcoholic beverages is under the same roof or at one street address, each area shall be considered to be a separate premises for licensing purposes. |
RESIDENTIAL CARE FACILITY: | A group care facility licensed by the state for twenty-four (24)-hour medical or non-medical care of persons in need of personal services, supervision, or assistance essential for sustaining the activities of daily living, or for the protection of an individual. For purposes of this chapter, a residential care facility includes an independent living facility, assisted living facility and nursing home. |
RESTAURANT: | Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, which offers patrons complete meals, including dinner and/or luncheon menu at which the service of alcoholic beverages is incidental, complementary and subsidiary to the service of such meals. Limited food service, such as provided by lounges, luncheonettes, diners, coffee shops, drive-ins, pizza parlors and similar uses, does not satisfy the requirements of this definition. |
WINE: | Any alcoholic beverage obtained by the fermentation of the natural contents of fruits or vegetables, containing sugar, including such beverages when fortified by the addition of "alcohol", as defined herein. |
WORK LOUNGE: | A shared office establishment that includes a first floor use for the presentation of non-amplified music, theatrical plays, stand-up comedy, magic shows, and spoken word poetry performances, as well as events and group activities, such as salon-style discussions with authors, scholars and community members, trivia nights, murder-mystery events, birthday parties, holiday parties, anniversary parties, corporate off-site meetings and book club meetings and shall also include the sale of alcoholic liquors for consumption on the premises.
