8-35-6: PERMIT REQUIRED; FEE:
Any person or entity providing valet parking service for a special event within the Village must first apply for and obtain a special event valet parking service permit which shall remain in effect for the duration of the event and shall be available for inspection upon request by any law enforcement or code enforcement officer of the Village.
The person or entity applying for the permit shall be the person responsible for the event and shall provide the time, date and location of the event; the applicant's name, address, phone number and relationship to the event; the location from which vehicles will be taken and to which they will be returned; and the names, addresses, and driver's license numbers of each person providing valet service for the event. The fee for a special event valet parking service permit shall be twenty five dollars ($25.00) per day. (Ord. 1995-0-80, 11-6-95)
8-35-7: PARKING PROHIBITED:
No person shall park his or her vehicle in a designated valet parking loading zone when the licensed valet parking service is in operation and the valet parking license sign is clearly displayed near the curb, but not in the street, between the loading zone signs. (Ord. 1995-0-80, 11-6-95)
8-35-8: VIOLATIONS; PENALTY:
Any person convicted of a violation of any provisions of Sections 8-35-2 and 8-35-4 shall be fined not less than fifty dollars ($50.00) and not more than five hundred dollars ($500.00) for each offense, and each day that an offense continues shall constitute a separate and distinct offense. In addition, the license of each valet parking operator who has been convicted of three (3) such offenses within a one hundred eighty (180) day period shall be revoked by the Village Clerk. 8-36-1: DEFINITIONS:
For purposes of this article, the following words and combinations of words are defined as follows:
DAYS: Calendar days.
DONATION BOX: An outdoor container made of metal or similar material for permanent or temporary outdoor use, designed and intended for the collection of clothing, shoes, textiles, books, electronics or other household items, for the purpose of recycling or donation.
DONATION BOX OWNER: Any organization, firm or other entity that owns and receives a permit to locate and operate a donation box in the Village pursuant to this article.
PERMITTEE: The donation box owner and the site host who shall each be jointly and severally responsible for compliance with this article.
SITE HOST: The lawful occupant, either by leasehold or ownership, of the property on which a donation box is located. The site host must also operate a business or other lawful activity at the site.
VILLAGE MANAGER: The Village Manager or the Village Manager's designee. (Ord. 15-075, 3-16-2015)
8-36-2: PERMIT REQUIRED; EXPIRATION:
   A.   It shall be unlawful to erect, place, maintain, operate or host a donation box without first applying for and obtaining a permit issued by the Village.
   B.   The Village shall approve an application for a donation box and issue a permit therefor if such application complies with the requirements of sections 8-36-3 and 8-36-4 of this article.
   C.   The permit shall be issued to the donation box owner and the site host who shall be jointly and severally liable for complying with this article.
   D.   The fee for a donation box permit shall be seventy five dollars ($75.00). If the donation box owner is a not for profit corporation, as evidenced by the proof required pursuant to subsection 8-36-4C of this article, there shall be no permit fee.
   E.   A permit issued for the operation of a donation box shall be valid for one year except as provided in section 8-36-8 of this article. (Ord. 15-075, 3-16-2015)
8-36-3: QUALIFICATIONS OF PERMITTEES:
   A.   In order to qualify for a permit pursuant to this article, the donation box owner must be either:
      1.   A public charity and/or not for profit organization exempt from taxes under section 501(c)(3) of the United States internal revenue code, and in good standing with the state of Illinois; or
      2.   A business in good standing with the state of Illinois, which includes a for profit business.
   B.   In order to qualify for a permit pursuant to this article, the site host must be the owner or lawful occupant of the property where the box is proposed to be located, and must operate a business, school, church, or not for profit organization on the property. No permit shall be issued if there is no lawful business or other activity on the property. (Ord. 15-075, 3-16-2015)
