There is hereby adopted for the purpose of regulating "going out of business sales", an Act of the State of Illinois, entitled: "An Act to Regulate the Sale, Representation and Advertising of Goods, Wares or Merchandise to Prevent the Fraudulent Sale Thereof, to Provide Penalties Therefor and to Repeal Act Therein Named" 1 , approved July 23, 1959, as amended. Three (3) copies of such Act have been and now are on file in the office of the Village Clerk, and available for public use, inspection and examination.

In addition to the requirements of said State Act, if the applicant having a going out of business license is a lessee on the premises where the business is conducted, no such license shall be issued hereunder and no such sale shall be conducted unless the applicant has advised the lessor of the premises, in writing, that the applicant requires that the existing lease be terminated and that such request to terminate shall be irrevocable during the period covered by the license.
It shall be unlawful for any licensee hereunder to continue in business or to have an interest in any continuing business on the premises where the going out of business sale took place for a period of two (2) years after said sale. Each day that the licensee continues in business in violation of this Section shall be a separate offense. (Ord. 1981-0-70, 10-5-81)
That the operation of currency exchanges during the early morning hours tends to increase parking on public streets when such night parking is prohibited by Village Ordinance and tends to increase the incidence of crimes against the patrons, employees, and/or owners of currency exchanges by reason of the darkness and dearth of passers-by.
The term "currency exchange" means any person, except banks incorporated under the law of the United States, engaged in the business of providing facilities for cashing checks, drafts, money orders and all other evidences of money acceptable to such currency exchange for a fee or service charge, or other consideration. Provided, however, nothing herein shall be held to apply to any person engaged in the business of transporting for hire, bullion, currency, securities, negotiable or non-negotiable documents, jewels or other property of great monetary value, nor to any person engaged in the business of selling tangible personal property at retail who, in the course of such business and as an incident thereto, cashes checks, drafts, money orders or other evidences of money.
