(a) Except as provided in Subparagraph (C), no person shall park or store any commercial vehicle, commercial equipment, construction equipment, mobile structures, or pole trailers upon any public property located in any zoning district, including but not limited to public streets, stub streets, rights-of- way, sidewalks, and planting areas between sidewalks and curbs.
(b) The parking of commercial vehicles, commercial equipment, construction equipment, mobile structures or pole trailers, in any residential district shall be limited to the use of such articles in the performance of a service to the adjacent property for a reasonable period of the time necessary to complete such service.

After receiving one written warning, the owner of the commercial vehicle, commercial equipment, construction equipment, mobile structures or pole trailers sought to be stored or parked in violation of this article and the owner of the property upon which the articles are being kept (unless it is public property) shall each be responsible for compliance with the terms of this section/chapter. In any proceeding for violation of any parking or storage provision of this article, the person to whom the item is registered, as determined from the registration plate displayed on said item, shall be presumed in evidence to be the owner of such item. For purposes of determining the ownership of real property, it shall be presumed that the person whose name appears on the most recent tax assessment roll of the City of Flint is the owner of the property.

The requirement of this chapter may be modified or varied by the Zoning Board of Appeals of the City of Flint provided evidence is presented establishing that because of topography or other physical conditions of the property not caused by the applicant, enforcement of the provisions hereunder would create the most extreme hardship.

Violation of this ordinance is a civil infraction. Any person, or any person acting on behalf of another person violating any of the provisions of this article shall upon being found responsible be subject to a fine of not more than five hundred dollars ($500.00), unless such fine is suspended, reduced or waived in the discretion of the Court due to the most grave injustice. Violations of this article may subject the violator to injunctive relief. Each day that a violation of this article is continued or permitted to exist without compliance shall constitute a separate offense.

If any section, paragraph or provision of this ordinance shall be declared by the courts to be unconstitutional or invalid, such holdings shall not affect the validity of this ordinance as a whole or any part thereof, other than the parts so declared to be unconstitutional or invalid.
