No person shall cause or permit the emission of an air contaminant or water vapor including an air contaminant whose emission is not otherwise prohibited by this ordinance, or an air contaminant or water vapor which reacts or may react with any other air contaminant or natural air, and which causes or will cause detriment to the safety, health, welfare or comfort of any person or which causes or will cause damage to property or business.

Unless prior written approval is obtained from the Director, no person shall build, erect, install or use any article, machine, equipment or other contrivance, the sole purpose of which is to dilute or conceal an emission without resulting in a reduction in the total release of air contaminants to the outdoor atmosphere. This section does not apply to the control of odors.

(a) In the case of shutdown of control equipment for necessary scheduled maintenance unaccompanied by shutdown of the air contaminant source, the intent to shutdown such equipment shall be reported to the Director at least 24 hours prior to the planned shutdown. This prior notice shall include, but is not limited to the following:
(1) Identification and location of the specific control equipment to be taken out of service;
(2) The expected length of time that the control equipment will be out of service;
(3) The nature and quantity of emissions of air contaminants likely to occur during the shutdown;
(4) Description of the maintenance of the control equipment.
(b) In the event that any air contaminant source, control equipment or related facility breaks down in such a manner as to cause the emission of air contaminants in violation of this ordinance, the person responsible for such equipment shall immediately notify the Director of such failure or breakdown, and provide a written statement giving all pertinent facts, including the expected duration of the break. The Director shall be notified when the condition causing the failure or breakdown has been corrected and the equipment is again in operation.

Before issuance of a certificate of operation, the Director may require the owner of an air contaminant source, at the owner’s expense, to conduct source emission tests in conformity with §§ 4-19 and 4-21 in order to provide to the Director that the source is in compliance with the ordinance and with the conditions specified in the installation permit.

Tests shall be conducted in the manner set forth in the application or by another method acceptable to the Director and the results of such test shall be submitted to the Director.
(a) At least seven days before source emission tests are conducted pursuant to § 4-18 the owner of an air contaminant source, or his authorized agent, shall notify the Director in writing of the time and place of the tests and who will conduct them. The Director shall have the opportunity to witness these tests.
(b) Results in tests conducted pursuant to § 4-18 shall be submitted to the Director in a format prescribed by the Director within 30 days after the last date of the tests and the report shall be signed by the person or persons responsible for the tests.

The Director may conduct separate or additional tests of an installation on behalf of the City at a reasonable time and at the City’s expense. Sampling holes, safe scaffolding and pertinent allied facilities, but not instruments and sensing devices, as needed shall be requested in writing by the Director and provided by, and at the expense of the owner of the installation at such points as the Director requests. The owner shall provide a suitable power source to the point of testing so that sampling instruments can be operated as required. Analytical results of the samples collected by the Director shall be furnished to the owner.

Collected air contaminants shall be removed and disposed of in conformity with existing laws and this ordinance and at such intervals as are necessary to maintain the equipment at the required operation efficiency. Collection and disposal shall be performed in a manner so as not to introduce air contaminants to the outer air.
