9-8-8: PAYMENT FOR APPROVED REMEDIATION EFFORTS:
   A.   Payment; Reimbursement: If an applicant suffered a flooding event and received clean-up costs or funds for substantiated property damage, the City may pay or reimburse an applicant for the cost of approved remediation efforts actually incurred up to a maximum of ten thousand dollars ($10,000.00).
   B.   Eligibility: To be eligible for approved remediation effort funds, an applicant must submit a written request to the City Recorder for payment or reimbursement of approved remediation effort expenses within two (2) years of the flooding event. The approved remediation effort application must be delivered to the City Recorder in the manner set forth in subsection 9-8-4C of this chapter, include all of the information required by subsection 9-8-4B of this chapter, the requested amount of approved remediation effort funds, and plans that demonstrate, to the satisfaction of the City's Engineers, the proposed improvements or redesign of the property will to a reasonable degree of engineering certainty help prevent or mitigate future stormwater flooding events. If the City approves the proposed improvements or redesign of the property, the City's Risk Manager may pay or reimburse for expenses actually incurred in constructing the approved remediation effort not to exceed ten thousand dollars ($10,000.00).
   C.   Basis For Payment: If a proposed remediation effort is approved, payment shall be made based on:
      1.   Actual receipts or invoices for the costs to complete the approved remediation effort; or
      2.   The lowest of three (3) bids to have the approved remediation effort completed.
         a.   If the applicant requests payment based on bids, the applicant shall be required to substantiate that the work or property itemized in the bid was actually furnished within one year of the payment of funds for approved remediation efforts. Substantiation can be accomplished through inspection by the City's Risk Manager to verify the work, furnishing copies of building permits and/or building inspections that verify the work, submitting invoices for completion of work on the bid, or by declaration made pursuant to Utah Code section 78B-18a-104 verifying under criminal penalty of the State of Utah that the work or property itemized in the bid was actually provided and the costs reflected in the bid were actually incurred. The City may seek return of any funds not substantiated as provided for in this section.
   D.   City Fees: City fees required for implementation of the approved remediation effort described in this chapter shall be waived by the City, and not considered a portion of the costs for approved remediation efforts. (Ord. 18-09, 4-24-2018; amd. Ord. 21-11, 3-24-2021)
