9-8-5: NOTICE OF FLOOD REQUIREMENTS:
   A.   Flooding Notice: To be eligible for assistance under this chapter, an applicant must inform the City Recorder in writing that he/she suffered a stormwater flooding runoff event within forty five (45) days of the event's occurrence by filing a Flooding Notice. If a Flooding Notice is not filed with the City Recorder, the applicant is ineligible for financial assistance under this chapter.
      1.   The Flooding Notice must include all of the information required by subsection 9-8-4B of this chapter, whether the residence was rented or owner occupied, a brief description of the flooding and damage.
      2.   Upon receiving the Flooding Notice, the City's Risk Manager or his/her designee shall come inspect the property to substantiate the cause of the flood, any need for clean-up, the existence of any property damage, and the condition of any property that was damaged. The applicant shall fully cooperate with the City Risk Manager or designee to schedule an inspection of their property. If an applicant refuses to allow an inspection of their property within three (3) days of the City's Risk Manager's request to inspect, the applicant shall be ineligible for financial assistance under this chapter.
         a.   The City may not pay or reimburse the applicant for fixtures or personal property, such as furnaces, water heaters, flooring, furniture, electronics or any other type of personal property in the residence that are removed and disposed of before the City's Risk Manager has been given an opportunity to inspect and document its condition and damage. If an inspection by the City's Risk Manager cannot occur before clean-up of the property for health, safety, or other exigent reasons, the City may accept clear photographs or video of the property damage, flooding, and areas requiring clean-up. Photographs that do not adequately depict the property damage, flooding, or areas requiring clean- up, as determined by the City in its sole discretion, will not be accepted. Property and flooding damage not depicted or adequately depicted in photographs or video will not be paid for or reimbursed under this chapter. (Ord. 18-09, 4-24-2018; amd. Ord. 21-11, 3-24-2021)
