6-2-4: PUBLIC DISPLAYS:
   A.   Permit Required:
      1.   A permit shall be required for any public discharge of display fireworks.
      2.   The Fire Chief or designee may, upon application in writing, grant a permit for the public discharge of display fireworks. Such permit shall be issued upon a determination by the Fire Chief or designee that: a) the application for permit is complete; and b) the proposed display is of such a character and so located, discharged or fired, so as to be not hazardous to property or endanger any person. The Fire Chief or designee shall deny the permit if the application is not complete or the proposed display is determined to be hazardous. Sales, possession, use and distribution of such explosives for a permitted public display shall be lawful for that purpose only.
      3.   If the Fire Chief or designee does not issue a permit within fourteen (14) calendar days after receiving the written application, the application for permit shall be deemed to have been denied. An applicant whose application for permit is denied may file a written request for review with the City Council within thirty (30) calendar days after the denial. The written request for review shall be directed to the attention of the city recorder.
   B.   Application For Permit: All applications for permits shall be accompanied by payment of fees in an amount adopted by the City Council and shall set forth: 1) the date, hour and place of making such display; 2) the place of storing the fireworks prior to the display; 3) the names of persons making the display; 4) the name of the person in charge of the igniting, firing, setting off, exploding or causing to be exploded such fireworks; 5) evidence that the display operator has received a display operator's license from the State Fire Marshal Division; and 6) certificates evidencing public liability insurance coverage in favor of the applicant in amounts acceptable to the Fire Chief or designee, with insurance certificates designating the City as an additional named insured.
   C.   Location Approved: The location of the storage place shall be subject to the approval of the Fire Chief.
   D.   Nontransferable: No permit granted under this section shall be transferable. (2001 Code § 46-2-104; amd. Ord. 12-21, 8-22-2012; Ord. 21-04, 2-10-2021)
