Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle established by this division, except those provisions which by their nature can have no application.
No person shall ride or drive any animal or any vehicle over or across any newly made pavement or freshly painted marking in any street when a barrier or sign is in place warning persons not to drive over or across such pavement or marking, or when a sign is in place stating that the street or any portion thereof is closed.
No person shall drive or operate any bicycle, motor driven cycle, or any vehicle which is not drawn by a motor vehicle, or drive or ride any horses or livestock, upon any highway established as a freeway, as defined by Section 604.5 of the Vehicle Code, nor shall any pedestrian walk across or along any such street so designated and described except in space set aside for the use of pedestrians, provided official signs are in place giving notice of such restrictions.
It shall be unlawful for any pedestrian to cross any highway within 500 feet of any regularly established and maintained underpass, subway, bridge or grade separation intended for the use of pedestrians in crossing highways except by the use of such underpass, subway, bridge, or grade separation.
No amendment of this division with respect to a state highway and no resolution establishing any regulation with respect to a state highway shall take effect until such amendment or resolution is approved by the State Department of Public Works. The Road Commissioner shall not erect any signs or place any markings upon a state high unless the regulation imposed by such signs or markings has been approved by the State Department of Public Works. Within six months after receipt of written notice that the State Department of Public Works has withdrawn its approval of any regulation affecting a state highway, the Road Commissioner shall remove from such state highway any signs or markings giving notice of such regulation.
