Notice of sale shall be given pursuant to the requirements of Tex. Code of Criminal Procedure Article 18.17. Thereafter, property shall be offered for sale at public auction to the highest bidder. Such property may be sold as individual items or assembled in lots at the discretion of the purchasing agent. Provided, however, that the head of any department of the city may request, in writing, that any items offered or to be offered for sale be assigned to his or her department. The purchasing agent may, at his or her discretion, assign such item or items to such department or sell such item or items at public auction.

The public auction provided for in the preceding section shall be conducted at the place and hour designated in the notice. Non-cash sales will be allowed only to buyers with a bank letter or a third-party guarantee.

The purchasing agent shall conduct the public auction and he or she shall keep an accurate statement of each article sold and the price bid and paid therefor, and shall make a complete report in writing to the city treasurer of the time, place and manner of conducting such sale. All funds received on account of such auction shall be delivered to the city treasurer who shall give his or her receipt therefor.

It shall be unlawful for any officer or employee of the city, either directly or indirectly, to submit bids or to purchase at any sale any property sold pursuant to the provisions of this article.

Any person violating any of the provisions of this article shall be deemed guilty of a misdemeanor. In addition to the penalties otherwise provided, any officer or employee of the city violating any provision of this article shall forfeit his or her office or employment.
