ARTICLE III: ABANDONED OR UNCLAIMED PROPERTY

§ 27-41 DISPOSITION OF UNCLAIMED PROPERTY.
   All abandoned or unclaimed property of every kind which shall remain unclaimed with the police department for a period of four months without being claimed or reclaimed by the owners, whether known or not, may be sold at public auction or appropriated to the city’s use, as provided in this article.

§ 27-42 LIST OF SALEABLE PROPERTY; DELIVERY OF PROPERTY TO PURCHASING AGENT.
   The chief of police shall give to the purchasing agent of the city a list of all property subject to sale under this article and shall thereafter deliver such property to the purchasing agent before the date of sale and take a receipt from such purchasing agent showing in detail all property so delivered.

§ 27-43 NOTICE OF SALE; ASSIGNMENT OF PROPERTY TO CITY DEPARTMENTS.
   Notice of sale shall be given pursuant to the requirements of Tex. Code of Criminal Procedure Article 18.17. Thereafter, property shall be offered for sale at public auction to the highest bidder. Such property may be sold as individual items or assembled in lots at the discretion of the purchasing agent. Provided, however, that the head of any department of the city may request, in writing, that any items offered or to be offered for sale be assigned to his or her department. The purchasing agent may, at his or her discretion, assign such item or items to such department or sell such item or items at public auction.

§ 27-44 PLACE, HOUR OF AUCTION; NON-CASH SALES.
   The public auction provided for in the preceding section shall be conducted at the place and hour designated in the notice. Non-cash sales will be allowed only to buyers with a bank letter or a third-party guarantee.

§ 27-45 CONDUCT OF AUCTION; STATEMENT OF ARTICLES SOLD, PRICE BID AND PAID; DELIVERY OF PROCEEDS TO TREASURER.
   The purchasing agent shall conduct the public auction and he or she shall keep an accurate statement of each article sold and the price bid and paid therefor, and shall make a complete report in writing to the city treasurer of the time, place and manner of conducting such sale. All funds received on account of such auction shall be delivered to the city treasurer who shall give his or her receipt therefor.

§ 27-46 DISPOSITION OF FUNDS.
   The city treasurer shall place all funds received by him or her under and by virtue of this article to the credit of the general fund, to be thereafter disbursed as the city council shall order.
