Meeting called to Order by Mayor McCune
Roll: Cufr, Masirovits, McCune, Ward, Hansford.
Also Present: Terry Finger, Tim Lemire, Administrator Dan Weir, The Gazette
M. McCune - Asked Dan to explain the new Subdivision Regulations.
D. Weir - Explained the new version and how it brought the old zoning up to date with new information, also incorporated information from sidewalks, curbing etc. Added definitions where needed, soil conditions, flood plain, erosion control, water supply, fire hydrant locations, sewers, testing methods, what criteria is needed , traffic patterns, street names, blocks, geometric designs, pavement widths, vertical alignments, subgrades, storm drainage, off street parking, added a section in so that the Planning Commission has the ability to look at possible growth near or adjacent to a new development, for major growth. Surveying and monumentation, so everything is properly marked, lot layouts, buffer - currently 40 feet, Residential vs. Commercial now we are saying 100 feet. Also, asking that the developer provide at lease 2% of the total acreage for public parks or green areas, so we don't get a situation with all development, and no greenery. Tree planting, asking the developer to provide some type of plan.
G. Hansford - Is this going to cause a upheaval, is there a grandfather clause?
D. Weir - Yes.
G. Hansford - Is this radical enough to open a bees nest?
D. Weir - I don't know.
G. Hansford - I understand , we need an upgrade. I would like to see us avoid the same situation as we had with the Comprehensive Plan.
D. Weir - Now the property owner is basically responsible for the things that they want done.
M. McCune - Changing this into this type of document, doing this will save Council a lot of indecision, 20% want to pave, 40% don't, long meetings, etc. A lot less of the people getting the Village to do this, now the people have to do it. I don't think this is that radical. Once we adopt this document should be the law in developing subdivisions. If we are going to adopt this, let's make sure we are all on the same page.
G. Hansford - Discussed Jeffersonian Estates. Where is the enforcement.
M. McCune - I believe that the developer should know before he even gets started, if he is not following the regulations, you enforce it.
G. Hansford - Expressed that he doesn't want to pass this then have it changed for certain situations.
M. McCune - Expressed that he feels that the Village should be controlled, make sure that sewers are in tact, grants, drainage, this document addresses a lot of these issues.
G. Hansford - Is there a document for a performance bond?
M. McCune - Yes.
G. Hansford - Discussed multi family living.
M. McCune - Discussed converting from the old to the new. Expressed that some developers will be upset with these regulations but for the most part the people in Jefferson Village won't be.
E. Ward - Expressed that all the information in the subdivisions is where the concerns are in the Village. Doesn't feel that this will create a beehive.
D. Weir - We always get calls from people regarding sidewalks, I feel the sidewalk provision needs to be their.
J. Cufr - I think the sidewalks are needed.
L. Masirovits - Aren't we paying for sidewalks through taxes.
M. McCune explained that the property owner pays for the material and the Village pays for the labor. Are taxes to replace sidewalks are in the taxes. New sidewalks are basically the property owners responsibility.
E. Ward Discussed the preliminary on the plan review, and construction inspection escrow amount, the Village has been paying the fees, now we are trying to pass this on to the developer.
G. Hansford - Is there any consideration for upgrading the feeder roads? You keep getting new developments with no thought to opening the roads.
D. Weir - We have that stipulation in regards to the Planning Commission looking at this and reviewing those particulars.
G. Hansford - You could eliminate a lot of gridlock.
T. Lemire - To answer your question will this cause havoc, No. Not with the general developers. There is a country atmosphere about not having sidewalks. Page one, the Planning Commission makes the rules and there is no hearing by the City Council. It would seem to me that Council would want to be involved.
M. McCune - I can understand your concerns, you hire a engineer, then we ask our engineers to view the development plans.
T. Finger - This situation doesn't change. It says there will be a sum.
G. Hansford - Discussed appeals.
T. Finger - Asked about grant money for sewer improvements.
M. McCune - Explained the process.
T. Finger questioned getting an estimate from the engineer before proceeding.
T. Lemire - I did not have to deposit money in escrow to your engineers. It doesn't say that, it says that the Village will hire a engineer to review my engineers plans.
D. Weir - I think the primary thought behind that was, is it constructed according as to what was provided in the plan.
T. Lemire -Who's engineer?
D. Weir - A Village engineer, but I don't think that it would be that costly, unless you run into someone wanting a engineer on the job all the time.
M McCune - If we had a problem with the development we would need a engineer.
G. Hansford - It would all end up in court.
D. Weir - The Planning Commission gets the plans and if they want to approve, or something they disagree with, they have the right no to approve.
M. McCune- But, what happens when everything was approved and the developer does what he wants to anyway.
G. Hansford - Just looking at the result.
D. Weir - The Planning Commission can turn down a subdivision as many times as needed.
G. Hansford - When these things are being considered, I would like to have an opportunity to be a part of this process, to become more familiar with it.
T. Finger - We would rather have more people involved, more input.
M. McCune - The Council tries to do what's best for the Village. Maybe the Solicitor can give us some wording that can be endorsable but yet flexible.
E. Ward - I have one major concern, with the tree planting, I don't think the Village has a plan.
D- Weir - Yes we do.
M. McCune - I don't think there would be a disagreement with the type of trees.
T. Lemire - It seems a bit absurd.
M. McCune - That is what the plan is for, so we know what you think would be a good tree to plant. We have a better knowledge of trees now. In regards to sidewalks, I have never seen a whole street agree, I think with this plan we are trying to eliminate this disagreement.
T. Lemire - If they want sidewalks they should contract out the work. How much are sidewalks?
D. Weir - $16.00 a square, 16.00 per 4 by 4.
T. Lemire - So your talking thousands of dollars, to go out to nowhere and to end nowhere.
M. McCune - We thank you for your input, we understand that it is not a cheap item.
T. Finger - I would just like to say that when your subdivision opens, they'll probably be sold in 15 minutes.
M. McCune - You will have a chance to talk to Council.

G. Hansford - Will the papers be putting in any information about this.
The Gazette - Yes
G. Hansford - I just wanted other interested parties to attend.
M. McCune - Ultimately, I hope we can find something Council and everyone is comfortable with.
M. McCune set up meeting with Planning Commission and Council Saturday morning.
T. Finger - Would like at least two bodies are reporting to these meetings.
