Committee Council of the Whole
February 3, 1998
In Attendance: Terry Finger, Arthur Aho, Mary Stasny, Edwin Ward, Wilma Herndon, Jerome Lemire, Solicitor, Daniel Weir, Administrator.
Meeting Called to order at 7:00 p.m. by Terry Finger.
T. Finger - Reviewed Oath of Office and implications. Referred to Council supporting Village Ordinances. Suggested Council implement changes to Ordinances when needed, referred to Ohio Revised Code. Responsible Council actions are not motivated by personal vendetta.
A. Aho - Reviewed the Ohio Municipal League Seminar for Council members and suggested the sessions as information.
T. Finger - Approved of the layman terms and manner in which the Ohio Municipal League referees to Statute with their seminars.
T. Finger - Refereed to Rule 19 of the Codified Ordinances and reviewed with Council members.
A. Aho - Council Rules should be re-adopted every year.
T. Finger - If this is to be the case than it should be added to our Rules of Council that Council re-affirm.
J. Lemire - The opinion of the Attorney Generals office on the topic of a 1 year adoption is not currently law.
T. Finger - A motion from Council could be adopted every year to accept Council Rules, modify or adopt new rules as needed. In the 2 years that I have been on Council there has never been a review of Council Rules.
T. Finger - Reviewed Section 32.08. Explained Recreation Fee disagreement.
W. Herndon - Stated that she felt Marc Glotzbecker was hurt regarding remarks on fee structure etc.
T. Finger - Explained that sometimes legislation is introduced for Council Action and not reviewed by a Committee prior.
J. Lemire - Referred to Ordinances submitted for Police. If something is on an agenda and not introduced to a Committee than the Committee of Council is not required to introduce the legislation for Council action.
E. Ward - If the Mayor is going to hand directives down, Committees should be informed ahead of pending legislation or policy changes.
W. Herndon - An example should be given so people know what is effected.
T. Finger - Reviewed Council meetings referred to a need to control speakers who address the Mayor and Council during Council sessions.
W. Herndon - No need for time limit on speakers if kept under control.
T. Finger - Reviewed Chapter 32 - Review of Powers and duties of Council.
M. Stasny - Questioned review of our own Council rules.
T. Finger - That's correct, Council is reviewing our own rules.
T. Finger - Passed out Chapter 222 Ordinances and Resolutions. Ordinance is a permanent and lasting and needs to be put in Codified Ordinance Book. Resolutions are not of a permanent nature and are used for short term matters. Recommended bringing forth clarification of Ordinance and Resolution for adoption by Council.
Motion by Terry Finger that Jerry Lemire bring forth an Ordinance to define an Ordinance and Resolution.

T. Finger - Reviewed Roberts Rules of Order.
J. Lemire - We should adopt simple current Roberts Rules of Order.
T. Finger - Most current from book store, 1991.
T. Finger - Reviewed Council Rule 35 - 220.01.
J. Lemire - Approve one edition of Roberts Rules of Order. Suggested Roberts Rule of Order Modern Edition.
T. Finger - Council Rules 1 through 5 reviewed O.K.
J. Lemire - Council Rule 5, under resignations - brief explanation.
T. Finger - Suggested that Council resignations be submitted by letter.
T. Finger - Council Rule 5 stands as written - Committee agreed.
A. Aho - Council Rule 6, correction on "Personal Management" change to "Personnel Management" .
T. Finger - Council Rule 6 had a question on last sentence.
J. Lemire - Offered explanation.
T. Finger - Council Rule 6 - O.K. - Committee Agrees.
J. Lemire - Council Rule 7 - seems to be a point of controversy. Discussion persuaded. Council Rule - O.K. - Committee Agrees
Committee to add wording to Council Rule 7 - "Shall appoint standing Committee with approval of Council."

T. Finger - Council Rules 8 through 10 are O.K. - Committee agrees.
A. Aho - Questioned assigning Clerk other duties. Council Rule 11.
J. Lemire - Limit on what can be assigned. Suggested language " as may lawfully be assigned".
M. Stasny - Questioned on Members of Council taking notes.
J. Lemire - Mandated by Statute.
J. Lemire - Suggested Strike "in absence" from Council Rule 11.
Committee - Leave wording in Council Rule 11.
T. Finger - Questioned Council Rule 12 Length of time for Visitors Comments.
J. Lemire - Reviewed council Rule 28.
T. Finger - Council Rule 28 covers this situation.
Council Rule 12 O.K. - Committee agrees.
T. Finger - Council Rule 13 O.K. - Committee agrees.
Committee - Appointed Terry Finger Chairman of Committee Council of the Whole for future meetings.
