§ 1036.10 ESTABLISHING SEWAGE SURCHARGE.
   The village shall claim surcharges on discharges, whether they are continuous or an accidental spill, based on a grab sample or 24-hour composite sample. The composite sample shall be taken at least every two hours and an average shall be used. The surcharge shall be assessed for that particular 24-hour period. Where an individual, company or industry is continually discharging waste to the sewerage system, surcharges shall be binding, using a 30-day study made by the individual, company or industry and at least one composite and one grab sample per week. The village shall assess surcharges based on this 30-day study. The strength so found by analysis in accordance with § 1036.09 shall be used for establishing the surcharge, irrespective of whether payments are made monthly or quarterly. The results of routine sampling and analysis by the individual, company or industry shall be used in determining surcharge computations after being confirmed by tests performed by the village.
