Because it is desirable to have a community antenna television service available to the inhabitants of the village, Council hereby agrees to establish a franchise for community antenna television service for an initial franchise fee of $1,200, as set forth in § 812.05(a), and hereby establishes the following criteria for the operation of the same.
There shall be granted to qualified applicants, for the term of fifteen years, the nonexclusive right, power, privilege and authority to enter upon the streets, alleys, highways, sidewalks, bridges, tunnels and other public ways and public places of the village, for the purpose of constructing, maintaining and operating upon, through, under, over and across such streets, alleys, highways, sidewalks, bridges, tunnels and other public ways and public places, such towers, poles, wires, cables, cross-arms and apparatus (hereinafter referred to as the "facilities") as may be necessary or advantageous in carrying on the business of providing for the reception, transmission and distribution of television and other signals to the public in the village. All of the above services shall be subject to the requirements of the village. After applicants are found to be qualified and such service is found to be satisfactory in all respects, following an appropriate public proceeding, Council shall have the right to extend such term for two successive terms of five years.
