102.4 Referenced codes and standards. Where adopted by the authority having jurisdiction, the following codes shall be considered to be part of the requirements of this code: the International Building Code (IBC), the International Residential Code (IRC), the International Energy Conservation Code (IECC), the International Existing Building Code (IEBC), the International Fire Code (IFC), the International Fuel Gas Code (IFGC), the International Mechanical Code (IMC), and the National Electrical Code (NEC). All references to the International Plumbing Code (IPC) shall be construed as referring to the Uniform Plumbing Code (UPC), as adopted and amended by the Idaho State Plumbing Board, which is known as the Idaho State Plumbing Code.

102.6 Existing structures. The legal occupancy of any structure existing on the date of adoption of this code shall be permitted to continue without change, except as is specifically covered in this code, and where adopted by the authority having jurisdiction, the International Building Code, the International Existing Building Code, or the International Fire Code, or as is deemed necessary by the code official for the general safety and welfare of building occupants and the public.

103.1 General. The building official established under City adoption of the International Building Code and International Residential Code, shall be referred to as the code official and authority having jurisdiction under this code, and is hereby authorized and directed to enforce the provisions of this code. The code official shall have the authority to render interpretations of this code and to adopt policies and procedures in order to clarify the application of its provisions and how this code relates to other applicable codes and ordinances. Such interpretations, policies, and procedures shall be in compliance with the intent and purpose of this code and other applicable codes and ordinances. Such policies and procedures shall not have the effect of waiving requirements specifically provided for in this code or other applicable codes and ordinances.

103.5 Stop work order. Whenever the code official identifies any work regulated by the Green Construction Code being performed in a manner contrary to the provisions of this code or in a dangerous or unsafe manner, the code official is authorized to issue a stop work order in accordance with Section 115 of the International Building Code or Section 114 of the International Residential Code, whichever is applicable.

104.1 Information on construction documents. Where adopted by the authority having jurisdiction, the content and format of construction documents shall comply with the International Building Code or International Residential Code, whichever is applicable, including any documents or other data as required by Boise City submittal checklists submitted with each application for a permit.

105.6 Approved programs. The code official shall be permitted to deem other national, state, or local programs as equivalent to meet or exceed this code. Buildings approved in writing by such a program shall be considered to be in compliance with this code. Example programs include, but are not limited to, net zero, new buildings that achieve certification under the U.S. Green Building Council (USGBC) Leadership in Energy and Environmental Design (LEED) at Silver or higher or a rating of two (2) Green Globes or higher under the Green Globes program. Equivalency for existing buildings are those that achieve certification under the USGBC Leadership in Energy and Environmental Design (LEED) at Certified or higher or a rating of one (1) Green Globe or higher under the Green Globes program.

BOARD OF APPEALS
108.1 General. Appeals of orders, decisions, or determinations, made by the code official relative to the application and interpretation of this code shall be made to the Board of Appeals created under International Building Code amendments in the Building Code and International Residential Code amendments in the One-and-Two-Family Dwelling Building Code of Boise City Code.
