All positions, as determined by the Commission, requiring peculiar and exceptional qualifications of a scientific, technical, managerial, professional or educational nature, or positions where it is impractical to develop and administer competitive examinations may be placed in the non-competitive classified service.
Applicants for such positions who have the necessary qualifications, as determined by the Commission, may be given a non-competitive qualifying examination.
Applicants who qualify under the provisions of this section shall be placed on appropriate eligible lists in alphabetical order without a grade or ranking and the entire eligible list shall be certified to the Appointing Authority upon request. The Appointing Authority may appoint to such position any person on the list.
The detailed score of the successful candidates shall be kept on file by the Commission so long as the eligible list created from the examination remains in effect. These records may be inspected at the office of the Commission by any Appointing Authority to whom a certification has been issued.
The examination materials of successful and unsuccessful candidates shall be kept on file for ninety (90) calendar days from the posting of any such list.

No examination shall be deemed to have been completed until the markings and results have been determined, and the Commission has promulgated the same. After reviewing the results of an examination and before promulgation, if not satisfied, the Commission may reject it and order another examination held. No person taking an examination shall acquire any rights whatsoever until the Commission has examined and promulgated the list.
The Commission Rules, minutes, classification plan, eligible lists, certification lists and those other records defined as public records in accordance with applicable state law, shall be open to the public. Such records may be inspected during regular business hours, subject to reasonable conditions. All examinations and examination materials and papers are the property of the Commission and shall be kept confidential to the maximum extent permitted by law. Other paper, records, and supporting documents of the Commission may, at the discretion and with the consent of the Commission, be open to public inspection.
The firefighter selection process will be administered in accordance with the Uniform Guideline on Employee Selection Procedures (1978), 29 CFR Part 1607 and will entail:
A. A minority recruitment drive and orientation to the written competitive recruitment examination.
B. A written job-validated competitive recruitment examination developed in accordance with standard psychometric principles.
C. A background investigation and assessment.
D. A structured oral interview, if necessary.
E. A medical examination.
F. A physical ability examination.
G. Completion of the Fire Training Academy.
The review and appeals processes for applicants will remain as part of the selection process and the City will not utilize the "Rule of Three" or a strict rank-ordering based on scores achieved on a written competitive examination to certify an appointment from the Fire Recruit Eligibility List.
In accordance with the Uniform Guidelines on Employee Selection Procedures (1978), 29 CFR Part 1607, the City of Toledo Fire Fighter selection process will exist as described above, unless an alternative process that is demonstrated to have less adverse impact upon minorities and validity equal to or greater than the current selection process is identified.
The police officer selection process will be administered in accordance with the Uniform Guideline on Employee Selection Procedures (1978), 29 CFR Part 1607 and will entail:
A. A minority recruitment drive and orientation to the written competitive recruitment examination.
B. A written job-validated competitive recruitment examination developed in accordance with standard psychometric principles.
C. A background investigation and assessment.
D. A structured oral interview, if necessary.
E. A medical examination.
F. A physical ability examination.
G. A psychological examination.
H. Completion of the Police Training Academy.
I. Full-time Peace Officers with arrest powers, certified in any state within the United States, with now break in service for two (2) years at the time of application, may apply for a lateral appointment without taking the civil service examination outlined in Rule 50.00, Section 50.21. Such candidates laid off within two (2) years from the date of application or placed in a part-time or reserve position after having worked in a full-time position for two (2) consecutive years within two (2) years from the date of application, may still apply for a lateral appointment, provided the candidate holds an active peace officer certification. Lateral candidates must meet the criteria outlined in Section 50.21 C - H. Individuals that possess an Ohio Peace Officer Training Academy (OPOTA) certification, are not required to complete a physical ability examination (Letter F of the selection process). Lateral candidates must be approved by the Toledo Civil Service Commission. Once approved by the Commission, lateral candidates are placed on the eligibility list and eligible for selection by the Police Chief.
J. OPOTC graduate applicants that have completed and received a Letter of Completion OR Certificate of Completion from the Ohio Peace Officer Training Commission (OPOTC) within one (1) year from the date of application OR have completed and received a Letter of Completion OR Certificate of Completion from the Ohio Peace Officer Training Commission (OPOTC) within two (2) years from the date of application and completed the Peace Office Refresher Training course, may apply for appointment without taking the civil service examination outlined in Rule 50.00, Section 50.21.OR OPOTC graduate applicants that have completed and received a Letter of Completion or Certificate of Completion from the Ohio Peace Officer Training Commission (OPOTC) within two (2) years from the date of application and have completed the continuing professional training (CPT) required by OPOTA from the preceding year. OPOTC graduate candidates must still meet the criteria outlined in Section 50.21 C, D, E, F, G, and H but are not required to complete a physical ability examination (Section 50.21, Paragraph F above). All OPOTC graduate candidates must be approved by the Toledo Civil Service Commission. Once approved by the Commission, OPOTC graduate candidates are placed on the eligibility list and eligible for selection by the Police Chief.
