§ 3141.12 Certificates of Operation
   (a)   Issuing of Certificates. A Certificate of Operation shall be issued by the Commissioner when inspections and tests required by Section 3141.11 show that elevators, dumbwaiters, moving stairways, special equipment or amusement devices are installed in accordance with the provisions of OBBC, the Ohio Elevator Code and this Building Code.
   (b)   Numbering of Elevator Certificates. A Certificate of Operation for an elevator shall show the serial number of the elevator for which it is issued.
   (c)   Posting of Certificates. The Certificate of Operation shall be suitably framed, under glass, and shall be posted in a conspicuous location in the elevator car, or on, near, or plainly visible from the dumbwaiter, moving stairway, amusement device or special equipment to which it applies.
   (d)   Limited Certificates.
      (1)   The Commissioner may permit the temporary use of an elevator, dumbwaiter, or moving stairway for service during the installation or alteration of such equipment under the authority of a Limited Certificate of Operation.
      (2)   Such Limited Certificate for an elevator shall not be issued until the elevator shall have been tested under contract load, and the car safety and terminal stopping equipment shall have been tested to determine the safety of the equipment for construction purposes, and until permanent or temporary guards of enclosures are placed on the car and around the hoistway and at the landing entrances on each floor. Landing entrance guards shall be provided with locks that can be released from the hoistway side only. Automatic and continuous pressure elevators shall not be placed in temporary operation from the landing push buttons unless door locking devices and/or interlocks required by OBBC, the Ohio Elevator Code and this Building Code are installed and operative.
   (e)   Life of Limited Certificates. Limited Certificates of Operation shall be issued for a period not to exceed ninety (90) days. Such certificates may be renewed at the discretion of the Commissioner.
   (f)   Posting of Special Notice. Where a Limited Certificate of Operation is issued, a notice bearing the information that the equipment has not been finally approved shall be conspicuously posted on, near or visible from each entrance to such elevator, dumbwaiter or moving stairway.
§ 3141.13 Accidents
   The owner or lessee or person in charge of any of the devices regulated under the provisions of this chapter shall immediately notify the Commissioner of every accident to any person, or damage to the device or to apparatus on or about or in connection with such device involving repairs or replacements exceeding twenty-five dollars ($25.00) in cost, and shall afford the Commissioner every facility for investigating such accident or damage. The Commissioner shall make an investigation immediately thereafter, and shall file in his or her Division a full and complete report of such investigation. Such report shall give in detail all material facts and information available and the cause or causes so far as they can be determined. Such report shall be open to public inspection at all reasonable hours. When an accident involves the failure or destruction of any part of the construction or operating mechanism of such a device, it shall be unlawful to use such device until it has been made safe, and the Commissioner may, if he or she deems it necessary, order the discontinuance of the use of such device until a new Certificate of Operation has been issued by him or her for its use. It shall be unlawful to remove any part of the damaged construction or operating mechanism from the premises until permission to do so has been granted by the Commissioner.
§ 3141.14 Periodic Inspections and Tests
   (a)   All elevators, amusement devices and special equipment shall be tested by the owner in the presence of the Commissioner, or his or her authorized representative, at least once every six (6) months, and all such devices shall be inspected by the Commissioner or his or her authorized representative at the time of testing.
   (b)   All moving stairways, and the miscellaneous safety devices on dumbwaiters, shall be tested annually by the owner in the presence of the Commissioner or his or her authorized representative, and all such equipment shall be inspected by the Commissioner or his or her authorized representative at the time of testing.
   (c)   All tests shall be made in conformity with the rules therefor issued by the Cleveland Board of Building Standards and Building Appeals or any rules of the Ohio Board of Building Standards.
§ 3141.15 Order Discontinuing Use
   Whenever the Commissioner shall, from inspection or tests of any elevator, moving stairway, dumbwaiter, amusement device, or special equipment, determine that in the interest of public safety such elevator, moving stairway, dumbwaiter, amusement device, or special equipment, or any part or appliance thereof, is out of order or in an unsafe condition, he or she shall have the power to order the discontinuance of the use of any such elevator, moving stairway, dumbwaiter, amusement device, or special equipment, and to compel the person, firm, or corporation having control or possession or use thereof to discontinue such use until such elevator, moving stairway, dumbwaiter, amusement device, or special equipment, or part of appliance thereof, has been satisfactorily repaired or replaced so that such elevator, moving stairway, dumbwaiter, amusement device or special equipment, is in a safe and proper condition.
   To enforce the provisions of this section the Commissioner may revoke an existing Certificate of Operation and require that it be surrendered and may seal or order the sealing of such parts of the operating mechanism as will make the device inoperative, and it shall be a violation of OBBC, the Ohio Elevator Code or this Building Code for any person or persons other than the authorized inspector of the Commissioner to break or remove such seal.
§ 3141.16 Certificate of Inspection
   The Commissioner shall certify each elevator, dumbwaiter, moving stairway, amusement device or special equipment which, after inspection, is judged to be in conformity with the provisions of OBBC, the Ohio Elevator Code and this Building Code. Such certification shall be in the form of an endorsement on the Certificate of Operation required in Section 3141.12 and shall include the date of the inspection and the signature of the inspector.
§ 3141.17 Reshackling of Elevator Ropes
   The hoisting ropes of power elevators having drum-type hoisting machines shall be reshackled at the car ends once every twelve (12) months on machines located over the hatchway. On machines located below or at side of the hatchway the reshackling shall be done once in every twenty-four (24) months. When an approved type emergency clamping device is installed reshackling at the periods specified shall not be required.
   All counterweight ropes of drum machines shall be reshackled at the counter-weight ends once in every four (4) years.
   Notwithstanding the requirements for reshackling within the periods specified above, reshackling shall be made when inspection reveals any evidence of weakness or failure at shackles.
   When ropes are reshackled there shall be attached thereto a metal tag, which shall bear the name of the person or firm who performed such reshackling and the date on which such work was performed.
