If at any time after the creation of an eligible list the Commission has reason to believe that any person whose name appears on such list is not qualified for appointment because of incapacity developed subsequent to the examination, because of false statements made in his application or for other just and reasonable cause, said person shall be notified and given an opportunity to be heard. If said person shall fail to appear for such hearing, or it is established at such hearing that said eligible is disqualified or incapacitated for appointment, his name shall be removed from the eligible list.
After substantial job related evidence obtained from the background investigation has been presented to the Commission deeming police and/or fire recruitment candidates not qualified, the Commission shall remove said candidate's name and subsequently notify the candidate of such removal. Information from the background investigation is confidential and not open to the candidate's inspection.
Employees shall report changes of name and/or address promptly on appropriate forms to their supervisor. Such changes shall be promptly forwarded through channels to the Commission. It shall be the responsibility of all applicants and eligibles to promptly notify the Commission of any change of name and/or address immediately upon such change.
Names may be removed from an eligible list by action of the Commission for the following reasons in addition to those heretofore considered.
a. Request of the eligible.
b. Failure to report for the interview and/or failure to accept appointment upon certification unless a waiver of such certification is granted by the Commission.
c. Four (4) different certifications without receiving appointment.
d. Upon resignation, from promotional eligibility lists.
e. Any other just or reasonable cause as determined by the Commission.
Whenever a vacancy exists in the classified service, or a new position is to be created, the Appointing Authority shall immediately notify the Commission of the fact. When any such vacancy is to be filled, the Appointing Authority shall make a requisition upon forms prescribed by the Commission for the certification of names of eligibles for such positions and shall state whether the position is temporary or permanent, (if temporary, the duration of the employment) and any additional requirements that may be deemed necessary.
At the discretion of the Commission, any requisition may be investigated to determine whether the title for which the certification is being requested is proper, whether the position is temporary or permanent, and whether the conditions of employment described by the Appointing Authority are appropriate. Based upon the findings, the Commission shall determine the proper class title to be assigned and whether the position is temporary or permanent.
When a requisition is received, certification will be made in accordance with established priorities. In using established eligible lists, certification of the persons standing highest on the appropriate eligible list shall be initiated. The Secretary of the Commission may provide an additional name or names as required to meet the minimum requirements of the certification formula. This procedure may be necessary if individuals originally certified are no longer interested in employment, fail to appear for an interview, decline appointment or are otherwise not available.
The number to be certified for positions shall be determined by providing three (3) names for each vacancy.
Every person who is certified but not appointed must be considered on four (4) different certifications for permanent appointment. Candidates certified from a promotion-by-nomination list shall be interviewed wherever practicable and deemed necessary.
A certification shall not be charged against persons who are within appointing range when the certification is issued to fill a position currently held by a provisional employee who has completed the prescribed probationary period and is within appointing range on the eligibility list.
In all cases, certification shall be made without regard to sex, race, color or creed, except whenever "sex" is specified in a requisition with specific reasons therefor. The Commission may, at its discretion, certify only those of the sex so specified. Selective certification may be made from an eligible list by the Civil Service Commission for reasons of business necessity relating to candidate preferences, eligibility based on funding sources and requirements, specific job requirements, shift work and other reasons as determined by the Civil Service Commission.
If there are fewer than three (3) names remaining on an appropriate eligible list, these names will be certified and the Appointing Authority may select one, or he may reject the list and a provisional appointment may be made as hereinafter provided.
In case there is no eligible list for the class of positions for which certification is requested, or if fewer than three (3) names appear on such list, the Commission may direct the certification of names from eligible lists most nearly appropriate to the positions to be filled or order a new eligibility list to be established.
In case an eligible person's name appears on more than one list, appointment to a position in one class may be considered a waiver for appointment from other eligibility lists for classes the salary of which is equal or lower.
