151.99 Penalty
(A) (1) The Kentucky Standards of Safety Fire Prevention Code as revised and updated effective September 11, 1990, by the Department of Housing, Buildings and Construction and the Office of the State Fire Marshall, together with the standards and codes incorporated therein, shall be and the same is hereby approved and adopted by the city and shall be applicable to the construction, reconstruction, repair and maintenance of buildings or structures within the city.
(2) All subsequent amendments or revisions to the Kentucky Standards of Safety Fire Prevention Code adopted in this division (A) and the codes and standards incorporated therein which are approved by the Kentucky Department of Housing, Buildings and Construction and the Office of the Kentucky State Fire Marshall, or their successors in office, shall be as the date of such approval, automatically adopted and applicable and enforceable in the city.
(B) The National Building Code adopted in division (A) is amended to provide that in instances where wood frame construction is used in the construction, reconstruction, and repair of buildings or structures within the city, all load-bearing partitions and nonload-bearing partitions which are a part of the construction, reconstruction, or repair shall conform to the following standards of construction:
(1) Studs in one- and two-story buildings shall be not less than 2 by 4 inches with the wide face perpendicular to the partitions. In three-story buildings, studs in the first story shall be not less than 3 by 4 inches or 2 by 6 inches.
(2) Studs supporting floors shall be spaced not more than 16 inches, and those supporting ceilings and roofs shall be spaced not more than 16 inches.
(3) Double studs (or cripples) shall be provided on each side of openings exceeding six feet in width.
(4) Headers shall be provided over each opening in all partitions. Each header shall be supported by single studs (or cripples) on each side of the opening.
(5) Studs shall be capped with double top plates installed to provide overlapping at corners on exterior walls. End plates in double top plates shall be lapped at least 48 inches. The interior wall may be capped with a single plate if it is not a load bearing wall.
(6) All ceiling systems shall be at least two inches by six inches, spaced no more than 16 inches apart. Any conventional cut roof shall be at least two inches by six inches, spaced no more than 16 inches apart.
(C) The provisions of § 151.01(B) shall apply to the construction, reconstruction, or repair of all structures to which the Kentucky State Uniform Building Code does not apply. In any case where a provision of § 151.01 (B) is found to be in conflict with any applicable existing code, ordinance, or regulation of the city or of the Commonwealth of Kentucky, the provision which establishes the higher and more restrictive standard shall prevail.

(A) No person, firm, or corporation shall hereafter construct, build, or cause to be constructed or built any sewer line or water line intended for dedication to the public use or intended to be connected to and become a part of either the city water distribution system or the city sanitary sewer system, without having applied for and obtained a permit from the city Water and Sewer Commission.
(B) No person, firm, or corporation shall construct or cause to be constructed any sewer line intended to be connected from a structure to the city sanitary sewer system unless the minimum difference in elevation between the top of the sanitary sewer outfall line of the city shall be 16 inches above the top of the invert of the sanitary sewer line at the foundation of the structure.
(C) The city shall have no responsibility for any blockage on backups occurring in any sewer line which fails to conform to the requirements set out in division (B).

No permit for the construction of any sewer or water line shall be issued by the Water and Sewer Commission until the following action by the party seeking the permit is taken.
(A) A written application on forms to be provided by the Water and Sewer Commission and signed by the person, firm, or corporation seeking the permit shall be submitted to the Water and Sewer Commission.
(B) This application shall be accompanied by the following:
(1) A subdivision plat of the subdivision in which the water or sewer line is to be constructed, the plats showing thereon the signed approval of the City Planning Commission.
(2) A set of plans of the proposed sewer lines, showing plan and profile of the proposed sewer line and location of all manholes, lampholes, connections to existing sewer lines, and easements for rights-of-way, where required.
(3) A set of plans of the water lines showing plan and profile of the proposed water line and location of all valves, fireplugs, fittings, and easements for rights-of-way, where required.
(4) Designed computations showing performance of the proposed water and sewer lines with current regulations of the Water and Sewer Commission.
(5) A written certificate signed by an engineer licensed to practice in the Commonwealth of Kentucky, stating that the design of the water and sewer lines meets or exceeds the requirements of the current regulations of the Water and Sewer Commission.
