   SECTION 40.03 Age Limits
   No applicant shall be under the minimum legal age for employment as established by law at the time of making application for admission to an examination. Age limits designated to secure persons physically and otherwise qualified for certain classes of employment may be fixed by the Commission for any examination.
   A.   No person shall be eligible to receive original appointment as a Fire Fighter unless the person has reached the age of eighteen (18). No person age forty (40) or older at the final closing date for the Civil Service examination shall be eligible to receive an original appointment to the position of Fire Fighter.
   B.   No person shall be eligible to receive original appointment as a Police Officer unless the person has reached the age of twenty-one (21). No person age forty (40) or older at the final closing date for the Civil Service examination shall be eligible to receive an original appointment to the position of Police Officer. No person age forty-four (44) or older who retired from the Armed Services through regular retirement, temporary or permanent disability retirement, or temporary early retirement, shall be eligible to receive an original appointment to the position of Police Officer at the final closing date for the Civil Service examination shall be eligible to receive an original appointment to the position of Police Officer.
   C.   No person age forty-five (45) or older at the time of appointment (first day of work with the Toledo Police Department) shall be eligible to receive a lateral appointment to the position of Police Officer.
   D.   OPOTC Graduate - No person shall be eligible to receive original appointment as a Police Officer unless the person has reached the age of twenty-one (21). No person age forty (40) or older shall be eligible to receive an original appointment (first day of work with the Toledo Police Department) to the position of Police Officer. No person age forty-four (44) or older who retired from the Armed Services through regular retirement, temporary or permanent disability retirement, or temporary early retirement, shall be eligible to receive an original appointment (first day of work with the Toledo Police Department) to the position of Police Officer.

   SECTION 40.04 Residence
   Eligibles, upon appointment, must conform with the residency requirements of Section 61 of the Charter of the City of Toledo.
   SECTION 40.05 Applications
   Applications for any examination shall be made upon application forms prepared and approved by the Commission. All applications shall be legibly printed or written and applicants shall state under oath or affirmation all pertinent facts which may include the following subjects:
   a.    Name, address and telephone number.
   b.    Military Service.
   c.    Skills.
   d.    Previous employment.
   e.    Education.
   f.    References.
   g.    Such other information affecting the qualification of the applicant for admission to the examination as may be required of all such applicants by the Commission.
   SECTION 40.06 Filing of Applications
   Applications must be obtained at and filed at locations designated by the Commission within the time period established by the Commission.
   SECTION 40.07 Rejection of Applications
   All applications shall be reviewed and applications may be rejected, if the applicant has not met the qualifications specified on the announcement by the date of the examination, or has intentionally made false statements on his application with regard to any material fact. Applications may be rejected for any just or reasonable cause which is job-related, as determined by the Commission.
   Upon rejection of any application, the applicant shall be promptly notified of such fact and the reason therefor, whereupon he may, within three (3) working days after receipt of such notice, show cause, in writing, why such application should not have been rejected. If any such inquiry from a rejection is pending at the time an examination is scheduled to be held, the applicant shall be allowed to take the examination pending a decision in such inquiry.
   If the Commission finds the rejection justified, the examination papers shall not be included among those to be rated.
   SECTION 40.08 Admission Cards
   When examination admission cards are used, the applicant shall bring this card to the examination and a person who does not present such a card shall not be admitted except by authority of the examiner-in-charge.
   SECTION 40.09 Fingerprints
   The Commission may cause fingerprints of applicants for certain responsible positions to be taken and forwarded for processing.
