§ 236.07  FEES, PROFESSIONAL CONSULTING AND RELATED EXPENSES REQUIRED FROM APPLICANTS OR APPELLANTS.
   (a)   Fees and expenses.  In addition to all other fees required by the Kirtland Codified Ordinances, an applicant shall deposit, as provided in division (c) below, the fees and funds to pay for estimated expected expenses described in division (b) set forth below when making an application for any of the hereinafter described purposes unless the City Council, Board, Commission or Administrator involved determines that, by the nature of the application it is not necessary to do so.
   (b)   Purposes.  The purposes for which fees and/or funds are to be deposited shall include but not be limited to applications for approval of, permits for, amendments to or variances related to the following:
      (1)   Subdivisions as provided for in Chapters 1240 through 1248.
      (2)   Excavations, landfills and gradings as provided for in Chapter 1442.
      (3)   Floodplain management as provided for in Chapter 1446.
      (4)   Site and grading plans as provided for in Chapter 1452.
      (5)   Rezoning of land, zoning map amendment, or zoning text change as provided for in Chapters 1262 and 1299.
      (6)   Comprehensive Plan of the City of Kirtland as provided for in § 1226.01 of the Kirtland Code of Ordinances and R.C. § 713.02.
      (7)   Variance or appeal to the Board of Zoning Appeals as provided for in Chapter 1264.
      (8)   Variance from the Planning and Zoning Commission as same is provided for in the Kirtland Codified Ordinances.
      (9)   Telephone and electric service as provided in Chapter 1248.
      (10)   In any application or procedure, including those referred to hereinabove, for which the Board of Zoning Appeals, Planning and Zoning Commission, Council, or the Mayor, or other administrative official or agency, to whom the application is made, determines that, by nature of the application, the retention of expert and/or professional consulting services are required to assist in providing relevant evidence and making a fully informed determination. Such services may be contractually retained by the city for a fee calculated upon an hourly rate plus reasonable expenses or a fixed fee plus reasonable expenses.
      (11)   Securing the payment of advertising or other expenses that will be incurred by the city in the processing of such a request.
   (c)   Deposit of fees and funds. Applicant shall first deposit the required fees and/or funds in a special account with the Director of Finance, to defray such fees and expenses as are related to the applicant's request.
   (d)   Schedule of fees.  The following is a non-exclusive schedule of fees which are in addition to the normal or usual filing fee or any other fee provided for in the Kirtland Codified Ordinances.

   2.   Review deposit. Any unused review deposits will be returned to the applicant. If the deposited review funds are insufficient to cover the city's expenses, review will be suspended until additional review monies are deposited with the city.
   3.   Cash compliance bond deposit. Compliance deposits will be returned to the applicant when the project is satisfactorily completed, soil stabilized, roadways repaired, and any dispute resolved. If the deposited compliance bond funds are depleted due to any claim, the applicant shall deposit additional monies with the city upon receipt of an invoice from the Department of Finance. Failure to deposit the additional funds may result in a stop work order from the Mayor and/or a lien on the property.

   (e)   Application/or a variance or an appeal to the Board of Zoning Appeals.  Notwithstanding the provisions of division (d)(36) of this section, when an applicant makes application to the Board of Zoning Appeals for a variance or to file an appeal to the Board of Zoning Appeals, the applicant or appellant shall deposit funds to defray city expenses in the manner of, and pursuant to, the rules established in divisions (a), (b) and (c) of this section.
   (f)   Payment for professional consulting services.  If professional consulting services are rendered by the City Engineer, the City Planner and/or any other expert, professional or consultant not already employed by the city, the same shall be rendered and billed at prevailing contractual hourly rates for such consulting services or for a reasonable fixed fee to which the city has agreed. The applicant or appellant shall be responsible, as hereinabove provided, for the payment of the referred to fees.
   (g)   Special accounts for applicants.  The Director of Finance shall establish special accounts within the city's funds on behalf of applicants and, upon authorization of the Mayor, such applicant shall pay to the city, by way of reimbursement, or directly to the person rendering such services, all expenses incurred in connection with the applicant's business or proceedings with the city. Should any applicant's special account have a balance of less than 20 percent of the original deposit, the Mayor shall request in writing that the applicant provide an additional deposit so that the balance shall then equal the original deposit required. If such request is approved or disapproved by the city, or withdrawn by the applicant, all funds remaining in such special deposit account, after payment of all lawful charges thereupon, shall promptly be returned to the applicant. The Director of Finance shall furnish an accounting of charges to such account, at any reasonable time, upon request of the applicant and upon final dispersal.
   (h)   Failure to post deposit.  Upon failure of an applicant to post deposit funds to defray municipal costs or expenses, as hereinabove provided, the city may dismiss an application.
   (i)   Deposit does not ensure approval.  Nothing contained in this section shall obligate the city to grant its approval of an application or be construed as consideration therefor. Rather, the purpose of the deposits is to furnish the city with necessary technical data, information or opinion from professional or expert consultants, when requested or required by it on specific applications, or to defray necessary advertising and/or other administrative expenses, regardless of the outcome of the city's final decision, so that the city will continue to be governed by its officers' informed decisions upon each specific application or appeal.
   (j)   Application of section.  This section is not intended to repeal, abrogate or impair any other ordinance relating to fees or expenses to be paid by an applicant, and not specifically provided for hereinabove, but is deemed to be supplemental thereto. However, in the event of any conflict between this section and any other section of the code, this section will control.
