1315.06 REQUIREMENTS FOR PLUMBING CONTRACTOR'S LICENSE.
   (a)   Qualifications. Any person, firm, corporation or other entity seeking a plumbing contractor’s registration under this chapter shall comply with all of the following:
      (1)   The applicant shall present to the Chief Building Official a valid and unexpired plumbing contractor’s license issued pursuant to Ohio R.C. Chapter 4740.
      (2)   The applicant shall provide appropriate documentation and proof that the applicant has complied with all of the requirements of Ohio R.C. Chapter 4740.
      (3)   The applicant shall complete a registration application form to the satisfaction of the City’s Chief Building Official.
      (4)   The applicant shall provide proper and complete identification.

      (5)   The applicant shall tender an application fee in the amount of seventy-five dollars ($75.00).

      (6)   The applicant shall provide documentation and proof that the applicant has obtained, and has in full force and effect, contractor’s liability insurance as required by Ohio R.C. 4740.06(B)(4).
      (7)   The applicant shall provide documentation and proof that the applicant is in full compliance with Ohio R.C. Chapter 4121 and Ohio R.C. Chapter 4123.
      (8)   The applicant shall provide documentation and proof that the applicant has registered with the Income Tax Department of the City of Canton.
   (b)   Bond. A plumbing contractor registered under this section shall file a surety bond in the sum of ten thousand dollars ($10,000) with the Chief Building Official. Such bond shall be approved by the City Law Director and shall require the plumbing contractor to save and keep the City harmless from all losses and damages that may arise from the negligence or failure of the plumbing contractor or his employees and agents, to comply with the provisions of this chapter. Such bond shall continue in full force and effect during each period that the plumbing contractor has an active registration with the City.

   (c)   Registration Fee. A registration fee in the amount of one hundred fifty dollars ($150.00) shall be tendered by the plumbing contractor upon the issuance of a registration certificate. Registrations issued during the year shall require the full year's registration fee. Such registration shall be renewable annually on or before December 31 of each year.

   (d)   Workers’ Compensation Certificate. An applicant for a plumbing contractor’s registration shall submit a copy of his Workers’ Compensation certificate prior to being eligible for a registration. (Ord. 258-2001. Passed 12-10-01.)
   (e)   Renewal. A registration shall be renewed annually upon the presentation of a valid and unexpired plumbing contractor's issued pursuant to Ohio R.C. Chapter 4740 and upon the payment of one hundred fifty dollars ($150.00) on or before December 31 of each year without the requirement of reapplication. A seventy-five dollar ($75.00) late fee shall be assessed for registration renewals after December 31.

   (f)   No person, partnership, corporation or unincorporated association may hold or renew a Plumbing Contractor Registration unless the Contractor is paid in full or is current and not otherwise delinquent in the payment of City income taxes, including any obligation to pay taxes withheld from employees under Section 182.05 and any payment on net profits under Section 182.06.
      (1)   A certificate of compliance issued by the Treasurer or the Canton Income Tax Department must be provided at the time of application for registration or renewal.
      (2)   Falsification of any information related to or any violation of the requirement to pay City income taxes set forth in subsection (f) shall constitute cause for the rescission of the registration at the City’s discretion.
      (3)   No person, partnership, corporation or unincorporated association which has as one of its partners, shareholders or owners, a person who is a twenty percent (20%) or greater equity owner in such partnership, corporation or unincorporated association and who is delinquent in the payment of City income taxes as set forth in subsection (f), may receive or renew a registration with the City under Chapters 1311, 1312, 1313, 1315, 1317, 1319 or 1321.
      (4)   The licensed contractor agrees to withhold all City income taxes due or payable under Chapter 182 of the Codified Ordinances for wages, salaries, fees, and commissions paid to its employees and further agrees that any of its subcontractors shall be required to agree to withhold any such City income taxes due for services performed under this contract. In addition the licensed contractor agrees with the City regarding the manner of withholding of City income taxes as provided in Section 718.011(F) of the Ohio Revised Code.
         A.   Municipal income tax withholding provisions of Sections 718.011(B)(1) and 718.011(D) of the Ohio Revised Code shall not apply to qualifying wages paid to the licensed contractor’s or any of its subcontractor’s employees for work done or services performed or rendered inside the City or on City property.
         B.   The licensed contractor agrees to withhold income tax for the City from employees’ qualifying wages earned inside the City or on City property, beginning with the first day of work done or services performed or rendered inside the City.

1315.07 HOME OWNER'S EXEMPTION.
   (a)    No provision of this chapter shall be interpreted to require that the owner of a single-family dwelling, who personally performs work upon the premises occupied or to be occupied by the owner thereof as such owner’s established residence shall be licensed or registered. Such owner shall be issued a permit for the work providing he satisfactorily qualifies through an interview given by the Chief Building Official or his designee.
   (b)    All such work shall be done in conformity with the provisions of this chapter, the City or State Building Codes and laws, and no work shall be done unless all permits required by this chapter and the City Building Code are obtained.
   (c)    A home owner shall furnish a signed, sworn or affirmed affidavit that he is the owner and resident of such one-family dwelling and shall perform the work himself and intends to reside at that location for at least one year or more.

1315.08 EXCEPTIONS TO REQUIREMENTS OF PLUMBING CONTRACTOR REGISTRATION.
   A plumbing contractor's registration is not required for the replacement of food grinders or disposals, laundry and dishwashing appliances, and water softening, conditioning and treatment appliances, in less than four-unit dwelling structures.

1315.09 LICENSING REQUIREMENTS FOR JOURNEYMAN PLUMBER.
   Any individual who performs plumbing work in the City as a journeyman plumber shall comply with the requirements of this section:
   (a)   Examination. All individuals seeking a journeyman plumber’s license from the City shall successfully pass an examination. This examination shall be prescribed and administered by the Canton Construction Board. Such examinations shall be conducted at least once every two months, provided there is an applicant therefor. An applicant who fails the examination for a journeyman plumber’s license on two occasions within the preceding twelve months shall be prohibited from obtaining such a license, whether through further examinations or through reciprocity, for a period of one year from the date of the last examination.    (b)   Qualifications. All individuals seeking a license as a journeyman plumber shall provide proof to the satisfaction of the Chief Building Official or his designee and at least one member of the Plumbing Section of the Canton Construction Board that such applicant has worked as a plumber for a minimum of four years. Evenly divided opinions shall be resolved by the entire Board. By way of example and not limitation, this requirement may be satisfied by proof of a combination of practical experience and technical training from a plumber’s trade school approved by the U.S. Department of Labor, Bureau of Apprenticeship and Training. An applicant may appeal an adverse decision under this requirement to the entire Canton Construction Board.
   (c)   Acknowledgement. All individuals seeking a license as a journeyman plumber shall acknowledge in writing receipt of the list of requirements imposed by the City that are in addition to the requirements of the Ohio Plumbing Code.

   (d)   Application. An application for a journeyman plumber’s license shall be made in writing by the person applying for such license. Said application shall be on forms prescribed by the Canton Construction Board.

   (e)   Application Fee. Applicants for a journeyman plumber’s license shall pay a fee of thirty-five dollars ($35.00), which shall include fifteen dollars ($15.00) for a license fee and twenty dollars ($20.00) for the application fee.
   (f)   Proof of Exam. An applicant for a journeyman plumber’s license shall present to the Chief Building Official or his designee proof that he has successfully passed the examination referred to in subsection (a) hereof.
   (g)   Renewal. Licenses shall be renewed annually upon the payment of fifteen dollars ($15.00) on or before February 28 of each year without the requirement of reapplication. A twenty dollar ($20.00) late fee shall be assessed for license renewals after February 28. (Ord. 81-2004. Passed 5-10-04.)
   (h)   Reciprocity. In lieu of the requirement to successfully pass an examination administered by the Canton Construction Board, an applicant for a journeyman plumber’s license shall receive such license from the City of Canton Building Department if all of the first three conditions, or the fourth condition, are met:
      (1)   The applicant presents a valid and current journeyman license issued by a political subdivision within Stark County, Ohio; and
      (2)   The license from the other subdivision must have been issued after the applicant successfully passed an examination in such political subdivision to obtain the license, provided however, that the Plumbing Section of the Canton Construction Board must have determined that the qualifications and examination of such other political subdivision are the same or the equivalent of the qualifications and examination which would be required in the City of Canton; and
      (3)   The applicant presenting the license from another political subdivision must not have previously taken and failed the examination for a journeyman plumber’s license administered by the City of Canton and/or Canton Construction Board twice within the preceding twelve months; or
      (4)   The applicant presents a current, valid State of Ohio plumbing contractor’s license obtained through an examination.

   (i)   Requirements. An application for registration as plumbing apprentice shall be made in writing in the name of the person applying therefor on forms provided by the Chief Building Official which have been approved by the Canton Construction Board. The applicant also shall submit appropriate proof and documentation that the applicant presently is engaged in learning the plumbing and pipefitting trade by being indentured in a training program registered with and approved by the U.S. Department of Labor, Bureau of Apprenticeship and Training (Form ETA 671 or its replacement), and that the applicant is presently learning and being instructed in the plumbing trade by working under the direct supervision of a plumbing contractor or journeyman plumber as defined by this chapter. The applicant may not establish his/her participation in such approved training program by presenting documentation that the applicant has been issued a registration and/or license by another political subdivision within the State of Ohio or elsewhere. The applicant shall be required to pay a fee of twenty dollars ($20.00), which shall include ten dollars ($10.00) for an application fee and ten dollars ($10.00) for a registration fee in order to secure a plumbing apprentice registration. Such registration shall be renewed annually upon the payment of ten dollars ($10.00) on or before February 28 of each year without the necessity of a formal reapplication. A ten dollar ($10.00) late fee shall be assessed for plumbing apprentice registration renewals that occur after February 28. (Ord. 81-2004. Passed 5-10-04.)
1315.10 SUSPENSION OR REVOCATION.
   (a)   Suspension or Revocation. Any license or registration issued under this chapter may be suspended or revoked by written order of the Canton Construction Board for any of the following:
      (1)   Any violation of the Ohio Revised Code or City ordinances relating to plumbing work;
      (2)   For any failure to immediately, upon receiving notice from the Plumbing Inspector, repair or correct any work previously done which may be found in any respect to be defective or unlawful;
      (3)   If the license or registration was obtained by misrepresentation or fraud; or
      (4)   If the business transactions of the contractor have been marked by a practice of failure to satisfactorily perform its contracts.
   (b)   Records/Violations. The Plumbing Inspector shall keep a record showing the date, name of licensee, location, and owner or person in control of property where any work is performed contrary to City and/or state code requirements or where any plumbing contractor has failed to obtain a permit as required in this chapter. The Plumbing Inspector shall provide written notice to the licensee of such defects and the licensee or person responsible for the job shall
immediately correct such defects. If the licensee claims that the work or material on the job is proper, he shall, within two business days after receipt of notice from the Plumbing Inspector, appeal the determination of the Plumbing Inspector to the Canton Construction Board. The Board shall order a reinspection of the job by another pluming inspector and notify the licensee of the results of the second inspection. If the permit holder is dissatisfied with the report of the second inspector, the Board shall, upon written application of the licensee made within three business days after the second notice, give the licensee a hearing and the decision of the Board shall be final. The licensee shall thereafter immediately correct the defects determined by the Board to exist or be subject to suspension or revocation of his license pursuant to subsection (a) hereof.

1315.11 PERMITS REQUIRED.
   (a)    Application for permits shall be made in writing on forms prescribed by the City and shall state the name of the plumbing contractor or plumbing contracting firm which is to make the plumbing installation; name and address of the owner or owners of the building or property on which the work is to be done; street and number of building or property on which the work is to be done; and the date the work is likely to be commenced. Any contractor who fails to obtain permits required by this chapter prior to the beginning of work, except in those cases where the emergency installation of plumbing is necessary, shall be required to obtain and pay for the permits which were originally required and in addition thereto shall pay a penalty double the amount of the original permit fees. No other plumbing contractor may use the same permit.
   (b)    Substitution. The Plumbing Inspector may issue a second permit for a plumbing installation (rough or finish) upon receipt from the property owner, his authorized representative or a project general contractor, of a written signed statement advising the City that the original permit holder has been removed from the plumbing installation job and further identifying the registered plumbing contractor who has been retained to complete the plumbing installation. Issuance of a second permit shall be subject to all of the requirements of this chapter, to include payment of permit fees, and shall be further subject to the requirements that the second permit holder shall be responsible for the completion of the plumbing installation, to include any work initiated by the first permit holder, in accordance with the requirements of this chapter.
   (c)    Expiration. A plumbing permit shall be valid for a period of twelve months from date of issuance.
   (d)    Revocation. Any plumbing permit found by the Plumbing Inspector to have been obtained by misrepresentation of facts or subterfuge shall be subject to revocation by the Plumbing Inspector.

1315.12 PERMIT FEES.

   (b)    Extension and Replacement. If extension or replacement of fixtures or plumbing connected appliances, or the adding of new fixtures requiring additional waste and vent piping, extending water piping to new fixtures or other outlets or extending gas piping to other outlets, are made to the plumbing system, a permit shall be required and a fee shall be charged according to subsection (a) hereof.
