(a) Plumbing inspectors employed by the City shall hold a certificate of competency issued by the Ohio Department of Commerce pursuant to Ohio R.C. 3703.01, the Ohio Building Code and the Residential Code of Ohio.
(b) The duties of the Plumbing Inspector shall be to enforce all of the provisions of this chapter, the Ohio Building Code and the standards of any adopted or referenced codes.
(c) It shall be the duty and the responsibility of the Plumbing Inspector, and his duly appointed assistants, to monitor compliance with and to enforce all of the provisions of this chapter. If the Plumbing Inspector reasonably determines that a person is performing work covered by this chapter without first obtaining an appropriate license or registration, the Inspector shall immediately notify such person of the apparent violation. The alleged violator shall have five (5) work days to obtain the appropriate license or registration. If such person does not obtain an appropriate license or registration, the Inspector shall refer the apparent violation to the Canton Construction Board for hearing pursuant to Chapter 1309. The Board shall issue a notice of a due process hearing to the alleged violator. The alleged violator shall be given an opportunity to appear before the Board and present whatever evidence he/she has in mitigation of the charges. If the Board determines that the alleged violator was performing work covered by this chapter without first obtaining an appropriate license or registration, the Board shall issue an order prohibiting such person from performing any work until an appropriate license or registration is obtained. The remedies authorized in this section are in addition to any other remedies provided in this chapter.
(d) The construction, erection, and alteration of a building, and any addition thereto, and the equipment and maintenance thereof, shall conform to required plans which have been approved by the Chief Building Official, except for minor deviations which do not involve a violation of the rules of the Board. In the absence of fraud or a serious safety or sanitation hazard, any structure built in accordance with approved plans shall be conclusively presumed to comply with Ohio R.C. Chapters 3781 and 3791 and the rules of the Board.
(e) The Plumbing Inspector shall not, during his employment with the City as a certified Plumbing Inspector, be employed or engaged, directly or indirectly, in any manner, with any registered contractor, or enter into any contract for plumbing work for others, or furnish materials, plans or specifications for others engaged in plumbing in the City, or any plumbing installation connected to the City's water supply system.
(f) The Plumbing Inspector shall be under the direction and control of the Chief Building Official or his designee.
