Article 7: Penalty

The particular Model Construction Codes listed below (with revisions as may be hereinafter set forth) are hereby adopted and incorporated in this code of ordinances, as fully as if set out at length herein, for the purposes of establishing rules and regulations for the following activities carried on within the corporate limits of the city:
1. Building Code. The construction, alteration, removal, demolition, equipment, use, occupancy, location and maintenance of buildings and structures:
a. IPMC International Property Maintenance Code 2021, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided for the insurance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the city are hereby referred to, adopted and made a part of thereof, as if fully set out in this subsection 1., with the additions, insertions, deletions and changes, if any, prescribed of this subsection 1.
b. IEBC International Existing Building Code 2021 for regulating and governing the repair, alteration, change of occupancy, addition and relocation of existing buildings, including historic buildings, as herein provided; providing for the issuance of permits and collections of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Existing Building Code on file the office of the city and hereby referred to adopted, and made a part hereof, as if fully set out in this subsection 1., with the additions, insertions, deletions and changes, if any prescribed of this subsection 1.
2. Plumbing Code. The installation or alteration of plumbing and drainage systems for buildings and structures: International Plumbing Code (recommended by International Code Council Inc.), 2006 Edition;
3. Electrical Code. The provisions of basic standards for the installation or alteration of the electrical supply or equipment for buildings or structures: National Electrical Code (recommended by the National Fire Protection Association), 2008 Edition;
4. Housing Code. The provision of basic, minimum housing standards for the preservation of the health, safety and welfare of occupants of existing structures: Basic Housing and Property Maintenance Code (recommended by Building Officials and Code Administrators International - BOCA), 1996 Edition;
5. Fire Prevention Code. The provision of basic safeguards to life and property from the hazards of fire and explosion: International Fire Code (recommended by International Code Council, Inc.), 2006 Edition;
6. Gas Codes. The installation or alteration of gas systems for buildings or structures: International Fuel and Gas Code (recommended by the International Code Council), 2006 Edition;
7. Energy Conservation Code. The provision of basic standards for energy conservation in building and structures: International Energy Conservation Code (recommended by International Code Council, Inc.), 2006 Edition; and
8. Mechanical Code. The provision of basic standards for mechanical installations in buildings and structures: International Mechanical Code (recommended by International Code Council, Inc.), 2000 Edition.

1. Wherever the words “city” or “municipality” are used in these Model Construction Codes adopted, it shall mean the City of Cache, Oklahoma.
2. Wherever the words “Inspector”, “Building Inspector”, “Zoning Administration Officer” or “Administrative Official” are used in these Model Construction Codes adopted, it shall mean the municipal official currently assuming the duties and responsibilities of Municipal Building Inspector for the City of Cache, Oklahoma.
3. All official titles used in those Model Construction Codes adopted shall be interpreted as defined in this code of ordinances.
4. Maximum penalties for violation of provisions of those Model Construction Codes adopted shall be as provided in the penalty section of this chapter.
5. Notwithstanding any provisions of any of those Model Construction Codes adopted by this chapter, wood shingles may be used for roofing.
6. All limits, except “fire limits”, referred to in any of those Model Construction Codes adopted by this chapter are hereby established as the corporate limits of the City of Cache, Oklahoma.
7. Section 118.2 of the BOCA Building Code shall read as follows: “Any person who shall continue any work in or about the structure after having been served with a “stop work order”, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to the penalties as provided in the Cache City Code.”
8. Section 2906.1 of the BOCA Building Code shall read as follows: “A person shall not erect, install, remove, re-hang or maintain over public property any sign for which a permit is required under provision of this code until an approved bond shall have been filed or until an insurance policy shall have been filed for public liability in an amount to be designated by the City Council.”
9. Section P-l 18.2 of BOCA Plumbing Code shall read as follows: “Any person who shall continue any plumbing work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to the penalties as provided in the Cache City Code.”
10. Section P-303.2 of the BOCA Plumbing Code shall read as follows: “A public water main or public sewer system shall be considered available to a building when the building is located within 300 feet of the public water main or sewer.”
11. Section P-308.3 of the BOCA Plumbing shall read as follows: “Water service piping shall be installed below recorded frost penetration but not less than 2 feet 0 inches below grade. In climates with freezing temperatures, shall be protected against freezing by insulation or heat or both.”
12. Section P-308.4 of the Boca Building Code shall read as follows: “Building sewers that connect to private sewer disposal systems shall be a minimum of 12-5/8 inches below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 10 to 20 inches below grade. There shall be 1/8 inches fall per foot between house and septic tank.”
1. One copy of each of the Model Construction Codes adopted by the city, as set forth in § 4-1 herein is on file in the office of the City Clerk-Treasurer.
2. The provisions of the codes set forth in § 4-1 shall be held to be the minimum requirements adopted for the promotion of the public health, safety and general welfare. Whenever any of the provisions or requirements of the codes are inconsistent with the provisions of the city code of ordinances or state statutes, the provisions or requirements containing the most restrictive regulation shall govern within the corporate limits of the city.
Any certified municipal official, or other certified employee designated by the City Council, shall be responsible for enforcing the Model Construction Codes adopted by this code of ordinances. Said persons may bear such titles as “Building Inspector”, “Gas Inspector”, “Plumbing Inspector”, “Electrical Inspector”, “Zoning Administration Officer” and the like, as may be deemed appropriate to indicate their respective areas of concern, and shall be appointed or designated by the City Council.
1. Every person in charge of an improvement on a locally-designated historic site or in an historic district shall keep in good repair all of the exterior portions of such improvement and all interior portions which, if not so maintained, may cause, or tend to cause, the exterior portions of such improvement to fall into a state of disrepair. This section shall be in addition to all other provisions of law, local ordinance or codes requiring buildings or structures to be well maintained.
2. Insofar as they are applicable to an historic landmark, historic site or improvement in an historic district, any provision of any adopted Model Construction Codes may be varied or waived, on application, by the Municipal Building Inspector; provided, that, such variance or waiver does not endanger public health or safety.
3. Nothing contained in this chapter shall prohibit the construction, reconstruction, alteration, demolition or any improvement on an historic site or in an historic district, pursuant to written order of any federal or state agency or pursuant to any court judgment to remedy conditions determined to be dangerous to life or health. In such case, no approval from the Preservation Commission shall be required.
