§ 92.42 CONSUMER FIREWORKS REGULATIONS.
   (A)   Low-impact fireworks. Low-impact fireworks are not regulated by this subchapter, except as noted in § 92.42(E).
   (B)   Consumer fireworks.
      (1)   A person may ignite, discharge or use consumer fireworks, on the day preceding, the day of, or the day after a national holiday, except between the hours of 1:00 a.m. and 8:00 a.m.
      (2)   On days other than the day preceding, the day of, or the day after a national holiday, a person may ignite, discharge or use consumer fireworks at the following times:
      (a)   Sunday - Thursday: 11:00 a.m. - 9:00 p.m.;
      (b)   Friday and Saturday: 11:00 a.m. - 12:00 midnight.
   (C)   Sky lanterns. A person shall not ignite, discharge or use a sky lantern or Chinese lantern anywhere in the township.
   (D)   Permission to use property. A person shall not ignite, discharge or use consumer fireworks on public property, school property, church property or the property of another person, without that organization’s or person’s express permission to use those fireworks on those premises. Fireworks discharge and display shall be confined to the site on which the user has permission to use the fireworks.
   (E)   Under the influence. An individual shall not ignite, discharge or use consumer fireworks or low-impact fireworks while under the influence of alcoholic liquor, a controlled substance, or a combination of alcoholic liquor and a controlled substance, to the degree that mental and motor skills are impaired. With respect to alcohol, UNDER THE INFLUENCE shall be based on breath or blood alcohol concentration of 0.08% or greater.
   (F)   Burn ban. A person shall not ignite, discharge or use consumer fireworks when a burn ban is in effect for the township.
