Section l. That the following words and phrases when used in this section shall have the meaning respectively ascribed to them.
"Motor truck" means every motor vehicle designed primarily for carrying livestock, merchandise or freight of any kind.
"Light delivery truck" means any panel delivery truck or pick-up truck designed to carry merchandise or freight of any kind not to exceed two thousand (2,000) pounds.
"Special mobile equipment" means every vehicle not designed or used primarily for the transportation of persons or merchandise.
"Implement of husbandry" means every vehicle which is designed or used primarily for agricultural purposes.
Section 2. No person shall operate a motor truck, implement of husbandry, or special mobile equipment with a maximum weight of over three (3) tons over or upon the streets or portions of streets hereinafter designated except when making a delivery to a place located upon said street or portion thereof and this entrance shall be made from the nearest intersection where said delivery is to be made. Nothing in this section shall prevent the operation of a light delivery truck, panel delivery truck, or pick-up truck thereon.

STREET PORTION WHERE TRUCK TRAFFIC IS PROHIBITED

The Police Department, Street Department or Sign and Traffic Department may temporarily close or restrict the weight limit on sections of a street by City Council Resolution when reasonably necessary because of construction, reconstruction, maintenance, safety or natural disaster. The City shall cause to be erected "road closed" or weight limit signs and partial or total barricades in the roadway at each end of the closed section and on the closed street where that street is intersected by other streets if such intersection remains open. The City shall not be liable for any damages to any vehicle that enters the closed section of street or the contents of such vehicle or for any injuries to any person that enters the closed section of street, unless the damages are caused by gross negligence of the City.
Nothing herein shall be construed to prohibit or deny any person from gaining lawful access to the person's property or residence, nor shall it change or limit liability to such persons. (Ord. #3264, 3/21/83; '91 Rev.)
That Section 2B-41, Weight Limit Signs (R12-1 to 5), of the "Manual on Uniform Traffic Control Devices", published by Iowa Department of Transportation, is hereby adopted as part of the Traffic Code of the City of Waterloo, Iowa, and hereby incorporated by this reference as though fully set forth.
