953.15 UNLAWFUL USE OF CITY CONTAINERS.
   No person, firm or corporation other than a person, firm or corporation specifically authorized by the City to do so, shall deposit garbage, trash, rubbish, debris or other similar materials in any container provided by the City to its customers for the disposal of garbage, trash, rubbish, debris and other similar materials.

953.16 LOCATION OF REFUSE STORAGE CONTAINERS, YARD WASTE   CONTAINERS AND RECYCLING CONTAINERS.
   Between days of regular collection for solid waste items, the owner, tenant, lessee occupant or agent of any property, commercial or residential, shall provide a place to store refuse (including bulky waste), recyclables and/or yard waste which shall be sheltered from street view, if possible, given lot size and configuration. Compost piles shall be located on the property so as not to be visible from the street whenever possible. Refuse storage containers, compost piles, bulky waste, yard waste and/or recyclables must not impede pedestrian or vehicular traffic along sidewalks and streets. No refuse collection or pick up will occur in alleys. All refuse collection shall be curbside.

953.17 SET-OUT TIME FOR REFUSE, YARD WASTE AND RECYCLING CONTAINERS.
   All residential garbage, curbside recycling and yard waste collections will be normally made between the hours of 6:00 a.m. and 4:00 p.m. on the designated collection day. Refuse containers, refuse bags, garbage can liners, bulky waste, recycling containers, and/or yard waste containers shall be set out at the refuse collection site, curbside or alley, on the designated collection day before 6:00 a.m. and no earlier than 7:00 p.m. of the day preceding the regular collection day. Refuse containers, refuse bags, garbage can liners, bulky waste, recycling containers, and/or yard waste containers shall be removed from the refuse collection site no later than 8:00 p.m. on the day of the regular collection. The owner, tenant, lessee, occupant, or agent of any property shall promptly clean up and remove any scattered solid waste, rejected items, recyclable material and/or yard waste from the property before 9:00 p.m. on the day of the scheduled date of regular collection.

953.18 COLLECTION OF RECYCLABLE MATERIALS.
   (a)   Residences: Persons shall separate the following into two (2) separate containers from garbage generated at residences and shall store the materials until they are collected for recycling:
      (1)   All aluminum cans, steel and tin-plated steel food/beverage cans, all plastics as defined previously herein;
      (2)   Paper, newspaper, boxboard, office mix paper, magazines and junk mail.
   (b)   All residents receiving municipal waste collection services by or on behalf of the City shall source separate all designated recyclable materials into a recycling bin or clear plastic bag and place for collection in a manner defined in Section 953.17.
   (c)   Recycling bins shall be provided to each property owner and/or tenant free of charge. A replacement fee of $10.00 shall be charged if a recycling bin must be replaced.
   (d)   An owner, landlord, or agent of an owner or landlord of a multi-family dwelling with four or more units shall be deemed to have complied with its separation responsibilities if it establishes a collection system at each such property. Unless specifically approved by the Director of Public Works, the collection system shall include separate suitable receptacle specifically for collection and storing the separated recyclable materials which tenants have deposited, and written instructions to the occupants concerning the use and availability of the collection system. The receptacle shall be clearly marked as designated for only for recyclable materials and shall be placed in a location easily accessible to the tenants. Separate receptacles shall be provided and marked to enable the tenant to separate recyclables. Owners, landlords, or agents of owners or landlords who provide a collection system under this section shall not be liable for non-compliance of occupants of their buildings.
   (e)   Commercial, industrial, institutional and governmental establishments and community activities by public or private agencies or individuals include but are not limited to fairs, bazaars, festivals, socials, picnics, performances and organized sporting events attended by 200 or more individuals per day. Commercial, industrial, institutional and governmental establishments and community activities shall separate the following into two (2) separate containers:
      (1)   Aluminum cans, steel and tin-plated steel food/beverage cans and all plastics as defined previously herein;
      (2)   Paper, newspaper, boxboard, office mix paper, magazines and junk mail.
   (f)   An owner, landlord or agent of an owner or landlord of a commercial establishment that leases its premises to other such establishments shall be deemed to have complied with its separation responsibilities if it establishes a collection system meeting the requirements of the collection system for multi-family dwellings described in subsection (d) herein.
