953.13 BURNING TRASH.
   (a)    Permit Required. No person shall kindle or maintain any fire for the purpose of disposing trash, garbage, paper or building materials within the City. The burning of brush, grass clippings, leaves and yard debris shall be allowed with a permit from a representative of Saint Albans Fire Department. Permits can be obtained in person at either fire station, or digitally via the Saint Albans Fire Departments' website. This permit shall be effective only for the day it is issued.
   (b)    Location and Time Required. No person shall kindle or maintain any authorized fire on public or private land unless:
      (1)    The location is not less than fifty feet from any structure and adequate provision is made to prevent fire from spreading to within fifty feet of any structure.
      (2)    The fire is contained in an approved waste burner located safely not less than fifteen feet from any structure.
      (3)    All open burning shall take place between the hours of 7:00 a.m. to 9:00 p.m.
      (4)    During State fire session, all open burning shall take place between the hours of 5:00 p.m. to 9:00 p.m.
   (c)    Attendance of Open Fires. All authorized fires shall be constantly attended by a competent person until such fire is extinguished. This person shall have a garden hose connected to a water supply or any other fire extinguishing equipment readily available for use to prevent the spread of fire.
   (d)   Chief May Prohibit. The Chief of the Fire Department or his representative may prohibit outdoor burning when atmospheric conditions or local circumstances make such fires hazardous.
   (e)    Liability. A burning permit in no way relieves the applicant from full responsibility should fire escape and damage the property of another.
   (f)    Authority to Extinguish. The Fire Department shall have full authority to extinguish all unauthorized or authorized fires which may create a hazard on public or private land within the City.
   Violation of these rules and regulations shall be subject to penalties imposed by the
applicable State and City Codes.
