953.04 TRASH AND GARBAGE CONTAINER SPECIFICATIONS.
   The trash containers and garbage containers referred to in this article shall meet the following specifications:
   (a)    Trash Containers. Standard containers for the storage of trash shall be substantially made of metal or durable plastic and shall have a capacity of not less than ten nor more than forty gallons, and shall be equipped with at least two carrying handles, with a tight fitting cover. Otherwise, trash shall be contained in plastic bags or boxes, provided that the total weight does not exceed fifty pounds or the capacity of the container, whichever is less. Corrugated paper boxes are acceptable temporary containers for trash provided they are protected from the weather and damage by dogs, cats, or other animals until such time as the collection of the trash is made.
   (b)    Garbage Containers. Standard containers for the storage of garbage shall be substantially made of metal or durable plastic, leakproof, and watertight and shall have a capacity of not more than thirty gallons, and shall be equipped with at least two carrying handles and a tight fitting cover. No single-family residence shall be allowed more than three garbage containers as hereinbefore described.
   (c)    Business, Schools and Related Containerized Users. All businesses, schools and other organizations as designated by the Sanitation Commissioner or his designated representative, whose garbage requirements exceed the need for six garbage containers as hereinbefore defined between regularly scheduled pick- ups shall be required to provide metal bulk containers for the collection of their garbage which such metal bulk containers shall be constructed in accordance with the specifications of the Commissioner so as to be adaptable for use with the trucks used by the City or its independent contractor. Such specifications shall be subject to the approval of Council.
   (d)    Unsuitable Refuse Containers. Any refuse container which is no longer suitable for use by reason of rust, cracks, lack of tight fitting lid or lack of adequate handles may be condemned by the Commissioner or his authorized representative. In such event the Commissioner or his authorized representative shall place or cause to be placed upon the unfit container a red tag giving notice that such container is unfit and from the date of the placement of such tag upon the container the City or its independent contractor, as the case may be, shall no longer be obligated to remove any material placed in such container.
Further, such red tag shall give notice that the failure to properly provide for refuse and garbage containers and the removal of refuse and garbage will be subject to possible penalties of a fine not more than one hundred dollars ($100.00) or imprisonment of not more than thirty days in accordance with the applicable provisions of the Codified Ordinances.
