1-1-4: SEVERABILITY OF PARTS OF CODE:
Should any section, paragraph, sentence, clause, phrase or word of this code be declared invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining words, phrases, clauses, sentences, paragraphs or sections of this code, since the same would have been enacted by the Board of Trustees without the incorporation in this code of any such invalid or unconstitutional word, phrase, clause, sentence, paragraph or section. 1-1-5: GENERAL PENALTY; CONTINUING VIOLATIONS; PLACE OF CONFINEMENT:
Whenever in this code (or in any ordinance of the Village) any act is prohibited or is made or declared to be unlawful or an offense, or whenever in such code (or ordinance) the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such provision of this code (or any ordinance) shall be punishable by a fine not exceeding seven hundred fifty dollars ($750.00), or less than twenty dollars ($20.00). Each day any violation of any provision of this code (or of any ordinance) shall continue shall constitute a separate offense. Any person failing to pay any such fine shall be punished as provided in the Illinois municipal code. (Ord. 2000-0-12, 3-20-2000)
1-1-6: RECORD AND MEMORANDUM OF ORDINANCES:
All ordinances passed by the Board of Trustees shall be recorded by the Village Clerk in a proper book with indexes. The original shall be filed in the office of the Village Clerk, and due proof of publication of all ordinances requiring publication shall be procured by the Clerk, and such proof or affidavit of publication shall be attached to and filed away with the ordinances; and the Clerk shall also note in this book of ordinances, at the foot of the record of each ordinance, a memorandum of the date of the passage, and, if published or posted, of the date of the publication or posting of such ordinance. 1-1-7: PROVISIONS CONSTRUED AS CONTINUATIONS OF EXISTING ORDINANCES:
The provisions appearing in this code, so far as they are substantially the same as those of the municipal code of the Village of Oak Park of 1957 and those of all other ordinances existing at the time of the adoption of this code, shall be construed as a continuation thereof and not as new enactments. 1-1-8: CORPORATE SEAL; DESCRIPTION; FACSIMILE:
The corporate seal of the Village shall be circular in form and be so constructed as to impress upon paper the words "Village of Oak Park, Illinois. 1901" within a circle formed by a circular wreath of oak leaves and acorns, and the words "Organized, Village Seal", together with two (2) oak trees, an acorn surmounted by an eagle with spreading wings, and a sunburst in the center of the acorn, all enclosed within an inner circle. 1-1-9: CORPORATE SEAL; USE AND CUSTODY:
The corporate seal of the Village shall be and remain in the custody of the Village Clerk and any successor in office, to be used by the Clerk in all cases provided for by any provisions of this code or other ordinances of the Village or the laws of the state, and in all such other cases when the laws and customs of any state or nation require the use of the corporate seal of the Village. 1-1-10: BASE OR DATUM ESTABLISHED:
The base or datum for the Village levels shall be, and the same is hereby established, at the plane of the low water mark of Lake Michigan in the year 1847, as determined by the trustees of the Illinois and Michigan Canal, and being indicated by bench marks within the Village limits as follows:
   43.176 feet below the top of the southwest corner of square base of column at west side of south entrance to Emerson School;
   42.309 feet below the top of the southeast corner of square base of column at east side of west entrance to Whittier School;
   49.503 feet below the top of the northwest corner of the square stone base of the west column, at the north entrance to the former Municipal Building, Lake Street and Euclid Avenue. (1981 Code)
