When a developer enters into an agreement pursuant to Government Code Section 65915 to provide 10 to 20 percent of the total units of a housing development affordable for low or moderate income households, or 5 to 11 percent of units affordable to very low-income households, as defined in the California Health and Safety Code, the developer shall be eligible for a housing density bonus of up to 35 percent and up to three incentives or concessions if the housing development consists of five or more units.
