A. The mayor, with the advice and consent of the village trustees, shall designate an ethics advisor for the village. The duties of the ethics advisor may be delegated to an officer or employee of the village unless the position has been created as an office by the village board.
B. The ethics advisor shall provide guidance to the officers and public employees of the village concerning the interpretation of and compliance with the provisions of this code of ethics and state ethics laws. The ethics advisor shall perform such other duties as may be delegated by the village board. (Ord. 09-04-10, 4-20-2009)
A. The provisions of this section hereby specifically incorporate the provisions of 65 Illinois Compiled Statutes 5/11-74.4-4(n), as now or hereafter amended, the same as though each were specifically set forth herein.
B. If the public official, employee or family member fails or refuses to disclose his interest in any real property within a TIF project area or otherwise violates any of the provisions of this section, the public official or employee shall be subject to penalties and sanctions as otherwise provided under this code of ethics or the village code, as may be applicable. A. In the event of there being less than a quorum at any regular meeting of the village board of trustees, the members of the corporate authorities present may have served a summons on any absent members, such summons being served by any police officer of the village, and may demand the immediate presence of such member at the meeting if he is able to attend. Any member who shall ignore such a notice, or who shall wilfully fail to attend any regular or special meeting of the village board without good cause, may be fined an amount equal to one-twenty fourth (1/24) of such officer's annual salary, on a majority vote of all of the trustees elected to office.
B. Any member of the corporate authorities who fails to attend eighteen (18) regular or special meetings of the village board during any fiscal year, without good cause, may, after a due process hearing before the village board, be fined an amount equal to one-twenty fourth (1/24) of such officer's annual salary on a majority vote of all of the trustees elected to office. Each subsequent unexcused absence after the seventh absence shall be considered a separate and additional violation of this provision for which an additional fine may be assessed.
C. Participation in any regular or special meeting by electronic means shall not be considered an absence for the purposes of this section. (Ord. 09-04-10, 4-20-2009)
A. The employment of relatives in the same division or department of an organization may cause serious conflicts and problems with favoritism and employee morale. In addition to claims of partiality in treatment at work, personal conflicts from outside the work environment can be carried into day to day working relationships. The village is committed to monitoring situations in which family members work in the same division or department. In case of actual or potential problems, the village will take prompt action. This can include reassignment or, if necessary, termination of employment for one or both of the individuals involved.
B. An individual shall not occupy a position where he or she reports to or is supervised by his or her family member. This constitutes a "prohibited employee relationship".
C. Family members of elected or appointed village officials shall not become employed in any capacity with the village after the commencement of the elected or appointed official's term. This provision is not intended to require any action to address an existing employment relationship which began prior to an elected or appointed official first beginning to serve.
D. Family members of department directors and the village administrator shall not be employed in any capacity with the village.
E. The provisions of this policy shall not apply to any full time or regular part time employee of the village hired before the effective date of this revised policy. (Ord. 09-04-10, 4-20-2009)
If any provision of this code of ethics or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity does not affect other provisions or applications of this code of ethics which can be given effect without the invalid application or provisions, and, to this end, each such invalid provision or invalid application of this code of ethics is severable, unless otherwise provided by this code. It is hereby declared to be the legislative intent of the village that this code of ethics would have been adopted had any such unconstitutional or otherwise invalid provision or application not been included. A. A person who is found guilty of intentionally violating any provision of section 1-11-10, "Prohibited Political Activities", of this chapter shall be guilty of a class A misdemeanor.
B. A person who is found guilty of intentionally violating any provision of section 1-11-5, "Gift Ban", of this chapter shall be guilty of a business offense and may be fined at least one thousand dollars ($1,000.00) and up to five thousand dollars ($5,000.00).
C. Any person who is found guilty of intentionally making a false report alleging a violation of any provision of this chapter to the local enforcement authorities, the state's attorney or any other law enforcement official shall be guilty of a class A misdemeanor.
D. A violation of section 1-11-5 of this chapter shall be prosecuted as a quasi-criminal offense by the village attorney.
E. In addition to any other penalty that may be applicable hereunder, a public official who is found guilty by a court of competent jurisdiction of violating any provision of section 1-11-5 or 1-11-10 of this chapter, or subsection C of this section, after a due process hearing before the village board, may be subject to discipline, or removal from office as otherwise may be authorized by law.
F. In addition to any other penalty that may be applicable hereunder, a public employee who is found guilty by a court of competent jurisdiction of violating any provision of section 1-11-5 or 1-11-10 of this chapter, or subsection C of this section may be subject to discipline and/or dismissal as may otherwise be determined by the village administrator.
G. The penalties provided in subsections A through F of this section are not exclusive and are in addition to any other regulations relating to public official or public employee sanctions or disciplinary procedures as may otherwise be authorized in the village code or Illinois municipal code for violation of this code of ethics or analogous statutory provisions.
