Any public official or employee who has, or whose family members have, an interest in a transaction which is the subject of an official act or action shall disclose on the record of the board or commission which performs such official act or to the village administrator, in the case of public employees, the nature and extent of such interest. Nothing herein shall be construed to permit the village, any public official or employee to participate in any transaction or do business with the village following such disclosure if it is otherwise prohibited by law. All public officials and public employees shall file a statement of economic interests with the village clerk before entering upon the duties of office or employment and annually thereafter at the same time that the public official or public employee is required to file a disclosure of economic interests with the county clerk in conformance with the Illinois governmental ethics act, or at such time as may otherwise be established by the village clerk. No public official or public employee, or family member of such public official or public employee, shall engage in private employment with, or render services for, any private person who has business transactions with the village unless such public official shall first make full public disclosure of the nature and extent of such employment or services. No public official or public employee shall, without prior formal authorization of the public body having jurisdiction, disclose any confidential information concerning any other public official or employee, or any other person, or any property or governmental affairs of the village. A. No former public official or public employee shall assist or represent any person other than himself or any family member in any judicial or administrative proceeding against the interests of the village or any of its agencies for a period of one year after the termination of the public official's or public employee's term of office or employment, if the public official or public employee was counsel of record or participated personally in the proceeding during his term of office or employment.
B. No former public official or public employee, or paid consultant of the village shall, for a period of one year after the termination of the public official's term of office, or of the employee's employment, or of the consultant's services, assist or represent any person, other than himself or any family member, in appearing before any board or commission of the village, or doing business with the village or any of its departments, if the official, employee or consultant participated personally in the subject matter of the transaction during his term of office or employment. Such public official, employee or consultant may be released from the terms of this subsection after review of the relevant facts of his case by the village administrator on the application of such former public official, former employee or consultant. The village administrator shall make a recommendation to the village board as to whether or not the former public official, former employee or consultant shall be released from the terms of this subsection, and thereafter, the village board shall render its decision, taking into consideration the recommendation of the village administrator. The decision of the village board shall be final.
C. No former elected public official of the village shall, for a period of two (2) years after the termination of the public official's term of office be eligible for employment by the village of Antioch in any capacity except as a volunteer or paid on call firefighter. Such public official may be released from the terms of this subsection after review of the relevant facts of his case by the village administrator on the application of such former public official. The village administrator shall make a recommendation to the village board as to whether or not the former public official shall be released from the terms of this subsection, and thereafter, the village board shall render its decision, taking into consideration the recommendation of the village administrator. Any current or former public official or employee shall, upon demand of the village administrator, account for all benefits accruing to such public official or employee as a result of any violation of this code of ethics. Any current or former public official or employee receiving any such benefits in violation of any of this code of ethics shall return such benefits and, in addition to any other penalty provided in this code of ethics, shall be subject to a penalty equal to two (2) times the amount of such benefits or the maximum amount permitted by law, whichever is less. If any such public official or employee refuses to account for benefits received in violation of any of this code of ethics, the village attorney may seek an accounting in a court of equity. A. The mayor, with the advice and consent of the village trustees, shall designate an ethics advisor for the village. The duties of the ethics advisor may be delegated to an officer or employee of the village unless the position has been created as an office by the village board.
B. The ethics advisor shall provide guidance to the officers and public employees of the village concerning the interpretation of and compliance with the provisions of this code of ethics and state ethics laws. The ethics advisor shall perform such other duties as may be delegated by the village board. (Ord. 09-04-10, 4-20-2009)
