Before any sanitary sewer system constructed by private, as distinguished from public, funding, hereinafter referred to as the "private sanitary sewer", shall be permitted to connect to the system, the owner of the system, hereinafter referred to as the developer, shall do and provide the township and the city with the following:
(A) Provide the township and the city with the developer's plans and specifications for construction, an estimate of the cost of construction and a performance bond and deposit with the township the estimated cost of review of construction plans covering the cost of hiring a registered professional engineer to review plans and specifications, which monies shall be placed by the township in an escrow account in the name of the developer;
(B) Obtain approval of the township and the city of the plans and specifications;
(C) Secure all necessary permits for construction;
(D) Upon commencement of construction of the private sanitary sewer, deposit with the township in the escrow account referred to herein of this section a sum of not less than 10% of the cost of construction of the wastewater system improvements to cover the anticipated cost of inspection of construction and payment of connection charges;
(E) Upon completion of connection of the private sanitary sewer to the system, the performance bond, upon recommendation of the township's Engineer and approval of the Township Board, shall be released and any monies remaining in the developer's escrow account shall be returned to the developer. Any additional expenses incurred by the township in assuring the township that the private sanitary sewer is properly operating shall be deducted therefrom or charged directly to the developer, at the option of the township. An accounting of expenditures shall be made to the developer by the township;
(F) Thereafter, in accordance with Chapter 155 of this code of ordinances, any accepted privately constructed main collector sewer system within a publicly dedicated right-of-way shall become a public sewer; and
(G) The township, by contract with a developer, as approved by resolution of the Township Board, may agree to collect benefit charges from third parties connecting to any privately constructed sanitary sewer system dedicated to the township system and rebate all or a portion of the charges to the developer to defray the developer's cost of construction of sewer system extensions constructed for the township.
