961.06   MARINE AND RESERVOIR POLICE SUPERVISOR.
   The City Manager shall nominate and appoint a Marine and Reservoir Police Supervisor, subject to the approval of Council. Such Supervisor shall directly supervise the use of the Reservoir and adjacent City owned lands and exercise police power over such property. He shall enforce the rules and regulations hereinafter set forth and subsequently promulgated by the City Manager as the duly authorized agent of the City Manager. He shall have the authority to inspect all boats, motors, slips and moorings to determine whether they are in compliance with the laws, rules and regulations. He shall make recommendations to the City Manager for the condemnation of any boats or docks and for the temporary or permanent suspension or cancellation of any license or permit where the terms or conditions of issuance have been violated, or for which the fees or rentals are in arrears. The City Manager shall have the authority to approve, reject or modify such recommendation.
   The Supervisor or his deputized patrolmen shall have the authority to arrest disorderly or drunken persons or persons littering Reservoir waters and adjoining City owned property and to arrest any person violating any of the laws, rules and regulations set forth in this chapter pertaining to the public use of the Reservoir and contiguous land, or in these Codified Ordinances or in the Ohio Revised Code.

961.07   OFFICERS' AUTHORITY.
   Marine and Reservoir. Police shall issue orders, either in person, in writing or by means of visible or audible signals, for the purpose of controlling the use of the Reservoir and adjacent City owned property in conformity with the provisions of this chapter. The Marine and Reservoir Police Supervisor shall determine when an emergency exists in the event of fire, high water, storm or other occurrence and, when reasonably necessary for the health, safety and welfare of the public or the inhabitants of the City, he shall issue and enforce such emergency orders as the conditions may require. For the protection of the health, safety and welfare of the public, users of Reservoir facilities and inhabitants of the City, he may restrict or prohibit boating on the Reservoir or the use of any City owned land or facilities adjacent thereto when he, the Superintendent of the Water Production Division or the City Manager has declared an emergency. A suitable, accepted signal shall be available at all times at the Reservoir site and shall be clearly displayed or sounded in the event of emergency.

961.08   OBEDIENCE TO OFFICERS.
   No person shall refuse or fail to comply with any lawful order, signal or direction of an officer of the Marine and Reservoir Police. No person shall resist, hinder, obstruct or abuse any officer of the Marine and Reservoir Police attempting to arrest offenders under any of the provisions applicable on or about the Willard Upground Raw Water Storage Reservoir or on contiguous City owned property.

961.09   CERTIFICATE, LICENSE AND REGISTRATION REQUIRED.
   No person shall operate any boat on the Willard Upground Raw Water Storage Reservoir without a valid certificate number for such boat issued by the Chief of Watercraft of the State. No person shall operate an outboard motor on such Reservoir without a valid license issued by such Chief. No person shall use a boat on the Reservoir without first registering the same on forms provided by the City. Each registration shall be effective for a period of three years, and thereafter must be renewed every three years. All registrations issued prior to June 1, 2007 shall be effective through December 31, 2008, at which time a new registration will be required.

961.10   IMPOUNDMENT, CONFISCATION AND SALE OF ABANDONED BOATS OR MOTORS.
   Any watercraft found unattended in a sunken, beached or drifting condition shall be deemed abandoned by the owner and shall be removed and impounded for safekeeping and disposal in accordance with this section. Any boat found moored in any slip, dock or mooring not legally assigned to the owner shall be impounded and removed from the water or locked up at some convenient point on shore. It shall not be released until a receipt from the Superintendent of the Water Production Division covering payment of a ten dollar ($10.00) impoundment fee, plus payment of a storage fee not to exceed one dollar ($1.00) per day for handling and services, is presented by the owner.
   The mailing of a written notice to the owner, if known, by certified mail, at the address given on the most recent license certificate filed by him, shall constitute sufficient service. If no response is received from the owner within ninety days after the date of mailing of the impoundment notice, the Superintendent shall consider the boat and/or equipment as abandoned, and it will become confiscated City owned property and shall be disposed of according to law.

961.11   RESERVOIR PROPERTY.
   No person on Willard Upground Raw Water Storage Reservoir property and adjacent City owned land shall:
   (a)   Buildings and Other Property.
      (1)   Disfiguration. Willfully mark, deface, injure, tamper with, displace or remove any building, table, dock, mooring stake, bench, landing, fireplace, railing, paving or paving material, water line, or other public utility or part or appurtenance thereof, sign, notice or placard, whether temporary or permanent, monument, stake, post or other boundary marker or other structure or equipment, facility or City property or appurtenance, either real or personal;
      (2)   Removal. Displace or remove any stone rip rap from the dikes on the Reservoir;
      (3)   Restrooms and washrooms. Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. No person over the age of five years shall use the restrooms and washrooms designated for the opposite sex;
      (4)   Removal of natural resources. Dig or remove any sand, whether submerged or not, or any soil, rock, stone, tree, shrub or plant, down timber or other wood or material, or make any excavation by tool, equipment, blasting or other means of agency;
      (5)   Erection of structures. Construct or erect any building or structure, whether permanent or temporary, or run or string any public service utility into, upon or across such land, except on special written permit issued by the Superintendent of the Water Production Division;
   (b)   Trees. Shrubbery and Lawns.
      (1)   Injury and removal. Damage, cut, carve, transplant or remove any tree or plant or injure the bark, or pick the flowers or seeds, of any tree or plant, nor shall any person attach any rope, wire or other contrivance to any tree or plant. No person shall dig in or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area;
      (2)   Climbing trees. Climb any tree or walk or stand or sit upon any monument, vase, fountain, railing, fence or any other property not designated or customarily used for such purposes;
      (3)   Hitching animals. Tie or hitch a dog or any other animal to any tree or plant;
   (c)   Wild Animals and Birds.
      (1)   Hunting. Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot or throw missiles at any animal or reptile, except as otherwise provided in this chapter;
      (2)   Waterfowl. Hunt any bird, with the exception of the lawful hunting of migratory birds pursuant to State and Federal laws and this chapter, provided, however, that such hunting is done only in areas specifically designated for waterfowl hunting by the City. Hunting hours shall be daylight to dark, except on Wednesdays, when no hunting shall be allowed from 12:00 noon to 3:00 p.m. This time will be used for reservoir maintenance. Hunting hours are not to be in violation of State or Federal waterfowl regulations. In addition, waterfowl hunters shall hunt only from within a duck hunting blind that meets permit requirements and that is located within an area designated specifically for waterfowl hunting. Each application for a duck hunting blind permit shall be accompanied by a fifty dollar ($50.00) deposit that shall be refundable in accordance with permit requirements. If the holder of the duck hunting blind permit violates the permit requirements, the deposit shall be forfeited to the City and the violator shall be refused a duck hunting blind permit for the following year.

   (d)   Target Shooting. Discharge any rifle, shotgun, handgun or other firearm, except while lawfully hunting pursuant to State and Federal laws and this chapter.

961.12   SANITATION.
   No person on Willard Upground Raw Water Storage Reservoir property or adjacent City owned land shall:
   (a)   Pollution of Waters. Throw, discharge or otherwise place or cause to be placed in Reservoir waters or any waters on City owned land adjacent thereto flowing into such waters any substance, matter or thing, liquid or solid, which will or may result in the contamination, littering or pollution of such waters, including, but not limited to, shavings, chips, straw, paper, shells, cinders, glass, mud, food, dung, filth, cans, manure, rubbish, oil or petroleum products, earth, gravel, brick, stone, metal, dirt, dye, detergent, liquid, powdered or solid chemicals or any other obnoxious substance;
   (b)   Refuse, Garbage and Trash. Have brought in or dump, deposit or leave any bottle, broken glass, ash, paper, box, can, dirt, rubbish, garbage, waste, refuse or other trash. No such refuse or trash shall be placed in any Reservoir waters or left anywhere on adjacent City owned lands, but shall be placed in the proper receptacles where they are provided; where such receptacles are not so provided, all such rubbish or waste shall be carried away from the Reservoir and City owned lands adjacent thereto by the person responsible for its presence and properly disposed of elsewhere.
