(A) There is hereby organized and established a volunteer fire department for the city to be known as the fire department of the city of Wendell, Idaho.
(B) The number of active members of the fire department shall be not more than thirty (30), nor less than ten (10), all of whom shall be over the age of eighteen (18) years, and shall be a person of good physique, free from disease and of good moral character; provided, that no more than twenty (20) of such members obligated to pay domestic water bills to the city shall be admitted as members of such department. The fire chief, assistant fire chief and fire marshal shall be appointed by the city council, and shall hold office until the expiration of the term of the appointing power, unless sooner removed by the city council.
The fire captains shall be appointed in the manner as provided in the bylaws of the fire department, and shall hold office during the pleasure of the fire chief.
(A) Duties Of Chief: The fire chief shall have absolute control of the fire department at all times, shall call meetings of the members and shall direct or cause to be directed all improvements of the department and shall see to it that they keep the apparatus and machinery under their care in proper order and ready at all times for active duty, and shall supervise and direct said department in fighting fires, or prevention of fires, and do all things required to be done to safeguard the city against loss by fire.
(B) Duties Of Assistant Chief: It shall be the duty of the assistant fire chief to attend any fire with the fire chief and assist him in the performance of his duties, and in the absence of the fire chief, he shall perform the duties of that office.
(C) Duties Of Fire Captains: It shall be the duty of the fire captains to attend any fire with the fire chief and/or assistant fire chief and assist them in the performance of their duties and in the absence of the fire chief and the assistant fire chief, to perform the duties of those offices.
(D) Duties Of Fire Marshal: It shall be the duty of the fire marshal to enforce all of the provisions of this code pertaining to fires and to perform all fire inspections required by the provisions of this code, ordinances of the county of Gooding, and statutes of the state of Idaho, and including the building code, the life safety code (NFP 101) and fire code.
(E) Police Powers: When on active duty, the fire chief and assistant fire chief shall each be vested with the authority of police officers of the city, with authority to make arrests, and shall each likewise have such police authority for the purpose of enforcing any ordinance of the city relating to matters from the duties of that office. Before entering upon the duties of their offices, the fire chief, assistant fire chief, fire captains and fire marshal shall take and subscribe an oath to support the constitution and laws of the state and the ordinances of the city, and to faithfully perform the duties of their respective offices according to the best of their ability.
