7-1-1: DEFINITIONS:
OWNER: Any form of legal or equitable ownership, whether individual, firm, partnership or corporation, or in any other fiduciary, legal or equitable capacity.
PUBLIC SIDEWALKS: For the purpose of this chapter and establishing owner's responsibility shall be those public sidewalks abutting the owner's property or those adjacent public sidewalks located between the owner's property frontage lines and the adjacent public street curb lines. In those locations where there is no curb, the responsibility of the said property owner for said repairs shall extend to the edge of the nearest public traffic lanes. (Ord. 339, 8-14-1986)
7-1-2: PERMIT REQUIREMENTS:
   (A)   No public sidewalk shall be repaired or installed by any person without first having a written permit from the city. A permit shall cover only contiguous construction and the work to be done as one continuous operation.
   (B)   A permit shall expire for work not started within forty five (45) days, or completed within one hundred eighty (180) days after the issuance of a permit. (Ord. 339, 8-14-1986)
7-1-3: CONSTRUCTION REGULATIONS:
   (A)   Construction And Grade Specifications: Applicant shall follow the provisions required by the City of Wendell or their representative for sidewalk construction and grade.
   (B)   Variances: The City Council may authorize variances from standard sidewalk provisions where no curb exists or when unusual topographical conditions, nature of existing construction, or similar factors would make adherence to standard provisions unreasonable.
   (C)   Inspection Of Work: All work shall be subject to inspection by the city during construction and upon completion. No concrete shall be poured without the permit and approval of the City of Wendell. (Ord. 339, 8-14-1986; amd. Ord. 551-2023, 6- -2023)
